"Interest and Sinking Fund" means the Interest and Sinking Fund established by Section 7.01(a) of this Ordinance. "Interest Payment Date" means the date or dates upon which interest on the Bonds is scheduled to be paid in accordance with the provisions of this Ordinance, such dates being February 1 and August 1 of each year commencing August 1, 1987. "Original Issue Date" means the initial date from which interest on the Bonds accrues and which is designated in Section 3.02(a) of this Ordinance. "Paying Agent/Registrar" means MBank Austin, N.A., Austin, Texas, any successor thereto or an entity which is appointed as and assumes the duties of paying agent/registrar as provided in this Ordinance. "Purchaser" means the person, firm or entity initially purchasing the Bonds from the City and which is designated in Section 12.01 of this Ordinance. "Record Date" means the record date as prescribed by Section 3.03(b) of this Ordinance. "Register" means the register specified in Section 3.06(a) of this Ordinance. "Surplus Revenues" means the revenues of the City's combined Waterworks and Sewer System, available after deduction of the reasonable expenses of operation and maintenance of said System and payment of all debt service, reserve and other requirements with respect to all of the City's revenue bonds and obligations, now outstanding or hereafter issued, that are payable from and secured by a lien on and pledge of all or part of the net revenues of said System. Section 1.02. Other Definitions. The terms "City," "Ordinance" and "Refunded Obligations" shall have the meanings assigned to them in the preamble to this Ordinance. Section 1.03. Findings. The declarations, determinations and findings declared, made and found in the preamble to this Ordinance are hereby adopted, restated and made a part of the operative provisions hereof. Section 1.04. Table of Contents. Titles and Headings. The table of contents, titles and headings of the Articles and Sections of this Ordinance have been inserted for convenience of reference only and are not to be considered a part hereof and shall not in any way modify or restrict any of the terms or provisions hereof and shall never be considered or given any effect in construing 1659f -3-
