<br />agree <br /> <br />that <br /> <br />a <br /> <br />part <br /> <br />this <br /> <br />will <br /> <br />be <br /> <br />made <br /> <br />survey <br /> <br />of <br /> <br />this <br /> <br />agreement. <br /> <br />The <br /> <br />assume <br /> <br />Lessee <br /> <br />to <br /> <br />the <br /> <br />of <br /> <br />agrees <br /> <br />said <br /> <br />cost <br /> <br />survey. <br /> <br />3. <br /> <br />Consideration. <br /> <br />As consideration and rental for the demised premises, Lessee <br /> <br />agrees <br /> <br />to pay to Lessor the <br /> <br />per <br /> <br />sum of five cents <br /> <br />($0.05) <br /> <br />square foot per year, payment to be made in advance and on <br /> <br />each <br /> <br />anniversary <br /> <br />date <br /> <br />this <br /> <br />of <br /> <br />lease. <br /> <br />Lessee <br /> <br />agrees <br /> <br />to <br /> <br />conduct and operate <br /> <br />a non-excl usi ve business <br /> <br />in <br /> <br />accordance <br /> <br />with the provisions in paragraph 15 hereinafter set out for a <br /> <br />term of twenty (20) years. <br /> <br />Lessee, if not in default at the <br /> <br />conclusion of the twenty-year period, <br /> <br />shall have the option <br /> <br />of renewing this lease <br /> <br />for an additional <br /> <br />fi ve-year period. <br /> <br />The <br /> <br />lease <br /> <br />payments <br /> <br />shall <br /> <br />reviewed <br /> <br />be <br /> <br />(5) <br /> <br />five <br /> <br />each <br /> <br />years <br /> <br />during the lease term in relation to the consumer price index <br /> <br />and <br /> <br />comparable <br /> <br />being <br /> <br />paid <br /> <br />rates <br /> <br />by <br /> <br />other <br /> <br />Lessees <br /> <br />on <br /> <br />the <br /> <br />Airport, <br /> <br />and <br /> <br />escalated <br /> <br />accordingly, <br /> <br />provided <br /> <br />that <br /> <br />the <br /> <br />original sum shall not be diminished. <br /> <br />The Lessee agrees to <br /> <br />pay to Lessor an annual fee equal to one percent <br /> <br />(1%) <br /> <br />gross <br /> <br />income <br /> <br />from <br /> <br />all <br /> <br />commercial <br /> <br />activity, <br /> <br />excluding <br /> <br />sales <br /> <br />or <br /> <br />services to federal, state, or local governments or other tax <br /> <br />exempt organizations or agencies. <br /> <br />Fuel <br /> <br />sales <br /> <br />shall be subject to a fuel flowage fee based on <br /> <br />cost of fuel delivered, <br /> <br />not gross <br /> <br />sales. <br /> <br />The <br /> <br />fuel <br /> <br />flowage <br /> <br />fee shall be as follows: <br /> <br />First year of Fuel Sales <br /> <br />- 2% <br /> <br />Second year of Fuel Sales <br /> <br />- 2.5% <br /> <br />Third year of Fuel Sales <br /> <br />- 3 % <br /> <br />Fourth year of Fuel Sales <br /> <br />- 3.5% <br /> <br />Fifth year of Fuel Sales <br /> <br />- 4% <br /> <br />All <br /> <br />consideration, <br /> <br />excluding <br /> <br />annual <br /> <br />footage <br /> <br />rental, <br /> <br />square <br /> <br />due and payable by Lessee to Lessor shall be payable monthly <br /> <br />within ten (10) days after closing of <br /> <br />each <br /> <br />monthly <br /> <br />payment <br /> <br />-2- <br />
