<br />period. <br /> <br />A copy of fuel delivery invoices shall accompany <br /> <br />each monthly payment to the Lessor. <br /> <br />Lessee shall provide to <br /> <br />Lessor any other business records reasonably necessary, as <br /> <br />deemed <br /> <br />by <br /> <br />Lessor, <br /> <br />verify <br /> <br />to <br /> <br />said <br /> <br />amount <br /> <br />of <br /> <br />fees. <br /> <br />As <br /> <br />additional <br /> <br />consideration for this lease, <br /> <br />Lessee agrees to <br /> <br />construct a building and other permanent improvements with a <br /> <br />fair market value of at least two hundred thousand dollars <br /> <br />($200,000.00), and construct the same with due diligence for <br /> <br />Lessee's uses as described hereunder, <br /> <br />said improvements to <br /> <br />become the property of Lessor as provided in Section 15, <br /> <br />Paragraph G. of this lease. <br /> <br />4. <br /> <br />Use of Demised Premises. <br /> <br />Lessee <br /> <br />is <br /> <br />to <br /> <br />hereby <br /> <br />granted <br /> <br />the <br /> <br />non-exclusive <br /> <br />privilege <br /> <br />engage in the business operations and services hereinafter <br /> <br />described: <br /> <br />A. <br /> <br />Flight <br /> <br />rental, <br /> <br />instruction <br /> <br />and <br /> <br />ground <br /> <br />school, <br /> <br />and <br /> <br />charter, and leasing of aircraft. <br /> <br />B. <br /> <br />Repair, modification, and maintenance of aircraft. <br /> <br />c. <br /> <br />other <br /> <br />direct <br /> <br />customer <br /> <br />support <br /> <br />such <br /> <br />car <br /> <br />rental, <br /> <br />as <br /> <br />vending of <br /> <br />instructional materials <br /> <br />supplies, <br /> <br />and <br /> <br />and <br /> <br />snack bar operation. <br /> <br />At the Lessee I s option, <br /> <br />fuel sales may be added, <br /> <br />thereby, <br /> <br />assuming the rights and obligations of a full service Fixed <br /> <br />Base Operator (FBO). <br /> <br />Fuel storage and dispensing facilities <br /> <br />will be a Lessee responsibility, subject to prior approval by <br /> <br />Lessor of all siting and construction. <br /> <br />Upon assuming FBO <br /> <br />status, the Lessee will also assume the added responsibility <br /> <br />to maintain the minimum performance standards as determined <br /> <br />by <br /> <br />the <br /> <br />Lessor <br /> <br />for <br /> <br />FBO <br /> <br />at <br /> <br />the <br /> <br />Marcos <br /> <br />Municipal <br /> <br />San <br /> <br />an <br /> <br />Airport. <br /> <br />These minimum performance standards will require <br /> <br />that the Lessee provide a comparable level of service as <br /> <br />other <br /> <br />operating <br /> <br />FBOs <br /> <br />Airport <br /> <br />the <br /> <br />that <br /> <br />no <br /> <br />unfair <br /> <br />on <br /> <br />so <br /> <br />business <br /> <br />advantage <br /> <br />resulting <br /> <br />from <br /> <br />Lessor <br /> <br />contractual <br /> <br />-3- <br />
