<br />7. <br /> <br />obligations is permitted. <br /> <br />This will not require that any <br /> <br />present leases be modified for the benefit of the Lessee. <br /> <br />5. <br /> <br />Term of Lease. <br /> <br />The <br /> <br />term <br /> <br />this <br /> <br />of <br /> <br />lease <br /> <br />for <br /> <br />the <br /> <br />described <br /> <br />property <br /> <br />in <br /> <br />Paragraph 2 and as shown on EXHIBIT A shall be for a term of <br /> <br />twenty <br /> <br />(20) <br /> <br />years, <br /> <br />wi th Lessee's right of renewal for an <br /> <br />additional five <br /> <br />(5) <br /> <br />years as provided in Paragraph 3, <br /> <br />and <br /> <br />beginning the <br /> <br />28 <br /> <br />day of <br /> <br />April <br /> <br />1987, <br /> <br />and running <br /> <br />through the 2 7 <br /> <br />day of April <br /> <br />, 2006. <br /> <br />6. <br /> <br />Lessee's Use of Airport Facilities. <br />During the term of this lease, the Lessor agrees that Lessee <br /> <br />shall have unrestricted access to the runways, taxi-ways and <br /> <br />ramp now in existence on the San Marcos Municipal Airport to <br /> <br />the same extent that any other parties may have use thereof. <br /> <br />It is understood and agreed by and between the parties hereto <br />that the continuing use of the Airport as an airport for <br /> <br />general aviation is essential to the operation of Lessee and <br />that failure to continue the use of the Airport for airport <br /> <br />and aviation purposes shall constitute a default in the lease <br /> <br />agreement; and upon giving notice by Lessee to Lessor of such <br /> <br />default and failure to cure~such default within thirty (30) <br /> <br />days <br /> <br />after the <br /> <br />giving <br /> <br />of <br /> <br />such notice, <br /> <br />this <br /> <br />lease <br /> <br />shall <br /> <br />terminate and end as of the date 120 days after such notice <br /> <br />shall have been given; and Lessee shall thereupon be released <br /> <br />from and relieved of all further obligations thereafter to <br /> <br />accrue <br /> <br />hereunder. <br /> <br />a <br /> <br />Lessor <br /> <br />shall <br /> <br />grant <br /> <br />to <br /> <br />Lessee <br /> <br />non-exclusive <br /> <br />right-of-way <br /> <br />suitable <br /> <br />in <br /> <br />width <br /> <br />for <br /> <br />use <br /> <br />by <br /> <br />vehicles in reaching the rear area of the leased property. <br />Lessee shall be responsible for the paving and maintenance of <br /> <br />said right-of-way. <br /> <br />Prior to paving said right-of-way Lessee <br /> <br />shall have plans for said paving approved by city. <br /> <br />Maintenance. <br /> <br />Maintenance <br /> <br />of <br /> <br />the <br /> <br />taxiways, <br /> <br />entrance <br /> <br />roads, <br /> <br />runways, <br /> <br />driveways, <br /> <br />existing <br /> <br />parking <br /> <br />leading <br /> <br />lots, <br /> <br />to <br /> <br />and/or <br /> <br />-4- <br />
