<br />-4- <br /> <br />State <br /> <br />University within the corporate limits of said City. <br /> <br />SECTION 9. That that portion of Moore Street in said City from <br />its intersection with Grace Street to its intersection with the north <br />line of Smith Avenue, is hereby vacated and abandoned as to any use, <br />right, claim in, or responsibility for the upkeep and maintenance by <br />the public in general and the City of San Marcos in particular, <br />save and except that utility easements are hereby expressly <br />retained for purposes of repair, relocation, reconstruction, and <br />maintenance of all utilities, public and private, whereever <br />located or to be located on, over, through and under said <br />property and/or on, over, through, and under any and all property <br />presently belonging to or which may subsequently belong to the State <br />of Texas for the use and benefit of Southwest Texas State <br />University within the corporate limits of said City; and, to declare <br />Moore Street from intersection with Smith Avenue up the hill in a <br />northwest direction a one-way street, and that Southwest Texas State <br />University will accept/provide signs on Southwest Texas State <br />University property declaring one-way status at top of hill and at any <br />other intersections with Moore Street on Southwest Texas State <br />University property. <br /> <br />SECTION 10. That the Mayor of the City of San Marcos, Texas <br />be, and he is hereby, authorized to execute a special warranty <br />deed to the State of Texas, for the use and benefit of Southwest <br />Texas State University, a copy of which is attached hereto and <br />incorporated herein for all purposes as Exhibit B. <br /> <br />SECTION 11. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions of <br />the Charter requiring that ordinances shall be presented at three <br />separate meetings and that no ordinance shall become effective until <br />the expiration of ten (10) days following the date of its final passage <br />be suspended, and these provisions are hereby suspended, and this <br />Ordinance shall take effect and be in full force and effect from and <br />after its adoption and after its publication in a newspaper of general <br />circulation in the area. <br /> <br />PASSED, APPROVED AND ADOPTED <br />1987. <br /> <br />t~e. 4 day of <br /> <br /> <br />.~~ <br /> <br />Mayor <br /> <br />May <br /> <br />~e~2Y~ <br /> <br />Janis K.
