RESOLUTION 1987-76R A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT WITH THE CITY OF NEW BRAUNFELS, TEXAS, ESTABLISHING RESPECTIVE EXTRATERRITORIAL JURISDICTION BOUNDARIES, AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT ON BEHALF OF SAN MARCOS, AND DECLARING AN EFFECTIVE DATE. 108 WHEREAS, pursuant to the laws of the State of Texas, ci ties of the State of Texas are authorized to enter into contracts regarding both governmental and proprietary functions; and, WHEREAS, the extraterritorial jurisdictions of the City of San Harcos and the City of New Braunfels will soon overlap due to the expansion of their boundaries done under the authority of the Municipal Annexation Act, Article 970a, Vernon's Texas Civil Statutes; and, WHEREAS, under the authority of Article 970a, Section 3, Vernon's Texas Civil Statutes, the cities desire to align their respective extraterritorial jurisdiction boundaries to prevent any overlap, prevent boundary conflicts and establish the effective jurisdictions of both cities now and in the future for all purposes, including the regulating of subdivision plats pursuant to Article 974a, Vernon's Texas Civil Statutes; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the agreement between City of San Marcos and the City of New Braunfels, Texas establishing their respective prospective extraterritorial jurisdiction boundaries, a copy of which is attached to this resolution and incorporated in it for all purposes, is approved. PART 2. That the Mayor of the City of San Marcos is authorized to execute the agreement on behalf of the City of San Marcos, Texas. PART 3.
