<br />RESOLUTION 1987-76R <br /> <br />A RESOLUTION OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING THE TERMS AND CONDITIONS <br />OF AN AGREEMENT WITH THE CITY OF NEW <br />BRAUNFELS, TEXAS, ESTABLISHING RESPECTIVE <br />EXTRATERRITORIAL JURISDICTION BOUNDARIES, <br />AUTHORIZING THE MAYOR TO EXECUTE THE <br />AGREEMENT ON BEHALF OF SAN MARCOS, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />108 <br /> <br />WHEREAS, pursuant to the laws of the State of Texas, <br />ci ties of the State of Texas are authorized to enter into <br />contracts regarding both governmental and proprietary <br />functions; and, <br /> <br />WHEREAS, the extraterritorial jurisdictions of the City <br />of San Harcos and the City of New Braunfels will soon overlap <br />due to the expansion of their boundaries done under the <br />authority of the Municipal Annexation Act, Article 970a, <br />Vernon's Texas Civil Statutes; and, <br /> <br />WHEREAS, under the authority of Article 970a, Section 3, <br />Vernon's Texas Civil Statutes, the cities desire to align <br />their respective extraterritorial jurisdiction boundaries to <br />prevent any overlap, prevent boundary conflicts and establish <br />the effective jurisdictions of both cities now and in the <br />future for all purposes, including the regulating of <br />subdivision plats pursuant to Article 974a, Vernon's Texas <br />Civil Statutes; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That the agreement between City of San Marcos <br />and the City of New Braunfels, Texas establishing their <br />respective prospective extraterritorial jurisdiction <br />boundaries, a copy of which is attached to this resolution <br />and incorporated in it for all purposes, is approved. <br /> <br />PART 2. That the Mayor of the City of San Marcos is <br />authorized to execute the agreement on behalf of the City of <br />San Marcos, Texas. <br /> <br />PART 3.
