109 AN AGREFMENT BETWEEN THE CITY Of SAN MARCOS, TEXAS, AND THE CITY Of NEW BRAUNfELS, TEXAS, CONCERNING THE CESSION Of' OVER LAPPI NG f.XTRA-TERRI TORI A L AREA STATE OF TEXAS KNOW ALL P~RSONS BY THESE PRESENTS: COUNTY OF HAYS THIS AGREEMENT effective June 1, 1987 is between the City of San Marcos, Texas, corporation duly incorporated under the Constitution entered into a municipal and laws 0 f the State of Texas, as a homerulp. City ( "San Marcos"), acting by and through its City Council, and the City of New Braunfels, Texas, a municipal corporation duly incorporated under the Constitution and laws of the State of Texas, as a homerule law City ("New Braunfels"), acting by and throUl~ h its City Council, WITNESSETH: \-lH ER EAS , pursuant to the laws of the State of Texas, cities of the State of Texas are authorized to enter into contracts regarding both governmental and proprietary functions: WHEREAS, the extraterritorial jurisdictions of the City of San Marcos and the City of New Braunfels will overlap soon due to the expansion of their boundaries done under the authority of the MUNICIPAL ANNEXATION ACT, Article 970a, Vernon's Texas Civil Statutes: and, WHEREAS, under the authority of Article 970a, Section 3, Vernon's Texas Civil Statutes, the City of San Marcos and the C1 ty of New Braunfels both desire to establish and realign, as appropriate, their respective extraterritorial jurisdiction boundaries to prevent any overlap, resolv~ boundary con fl lcts and establish the effect i ve jurisdictions of both cities now and in the fu ture for all purposes, including the regulating of subdivision plats pursuant to Article 974a, Vernon's Texas Civil Statutes: and, WHEREAS, the extraterritorial jurisdiction of th~ City of San Marcos is two miles and the extraterritorial jurisdiction of the City of New Braunfels is 2 miles; and,
