<br />-2- <br /> <br />WHEREAS, <br /> <br />all <br /> <br />the <br /> <br />territory <br /> <br />to be <br /> <br />included in <br /> <br />each <br /> <br />City's <br /> <br />jurisdiction <br /> <br />under <br /> <br />this <br /> <br />agreement <br /> <br />is or will be in the fores~able <br /> <br />future within each City's lawful <br /> <br />extraterritorial <br /> <br />jurisdiction, <br /> <br />now, <br /> <br />the re fore, <br /> <br />FOR AND IN CONSIDERATION of the premises and the mutual <br /> <br />~venants <br /> <br />herein contained <br /> <br />and <br /> <br />subject to the condítions set forth, the parties <br /> <br />cove nan t, <br /> <br />ag ree <br /> <br />and <br /> <br />bind <br /> <br />themselves as <br /> <br />follows: <br /> <br />I . <br /> <br />That <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />San <br /> <br />Marcos <br /> <br />and <br /> <br />the <br /> <br />City <br /> <br />of New Braunfels <br /> <br />ag ree <br /> <br />to <br /> <br />establish <br /> <br />their <br /> <br />respective <br /> <br />boundaries <br /> <br />a long <br /> <br />that <br /> <br />line <br /> <br />outlined in yellow on that certain map attached hereto and incorporated <br /> <br />herein for all purposes as Exhibit ~. <br /> <br />II. <br /> <br />That <br /> <br />the <br /> <br />City of San Marcos and the City of New Braunfels accept <br /> <br />and will exercise the <br /> <br />power <br /> <br />of <br /> <br />subdivision <br /> <br />approval <br /> <br />under <br /> <br />the <br /> <br />authority <br /> <br />of ~rticle <br /> <br />974a, <br /> <br />Vernon's <br /> <br />Texas <br /> <br />Civil <br /> <br />Statutes, <br /> <br />on all <br /> <br />lands <br /> <br />located <br /> <br />within <br /> <br />the <br /> <br />new <br /> <br />respec t i ve <br /> <br />contiguous <br /> <br />extraterritorial <br /> <br />jurisdictions <br /> <br />of <br /> <br />each City from and after such time <br /> <br />as said territory or any portion of said <br /> <br />terd tory <br /> <br />comes <br /> <br />within <br /> <br />the <br /> <br />respective extraterritorial jurisdiction of said cities. <br /> <br />III. <br /> <br />That <br /> <br />this <br /> <br />Agreement <br /> <br />shall <br /> <br />be in <br /> <br />fu 11 <br /> <br />force <br /> <br />and <br /> <br />effect <br /> <br />in <br /> <br />perpetuity unless cancelled, modified or amended by mutual <br /> <br />consent <br /> <br />of <br /> <br />the parties hereto. <br /> <br />IV. <br /> <br />If any provision in this Agreement or any application hereof shall <br /> <br />be <br /> <br />invalid, <br /> <br />illegal, or <br /> <br />uneforceable, <br /> <br />the <br /> <br />validity, <br /> <br />lega 1 i ty <br /> <br />and <br /> <br />en forceab i 1 i ty <br /> <br />of <br /> <br />the remaining provisions and applications shall not <br /> <br />in any way be effected or impaired thereby. <br /> <br />v. <br /> <br />This Agreement shall be construed in accordance with and <br /> <br />gove rned <br /> <br />by the laws of the State of Texas. <br /> <br />IN <br /> <br />WITNESS <br /> <br />WHEREOF, the parties have caused this Agreement to be <br /> <br />duly executed, their respective seals to be affixed to it and attested, <br /> <br />all as of the date and year written above. <br />
