<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING 4.51 ACRES OF LAND OUT OF THE L. GLASSGOW SURVEY,
<br />HAYS COUNTY, TEXAS, BEING A PORTION OF THAT 9.37 ACRE
<br />TRACT OF LAND CONVEYED TO FRANK HOCH BY WELDON SCHLM1EUS
<br />BY DEED DATED JANUARY 24,1953, AND RECORDED IN VOLUME
<br />155, PAGE 196, HAYS COUNTY DEED RECORDS, LOCATED ON THE
<br />SOUTHSIDE OF RANCH ROAD 12 WEST OF THE COUNTY ROAD 226
<br />INTERSECTION FRÅ’-1 "PD" (PREDEVELOPMENT DISTRICT) TO "c"
<br />(COMMERCIAL DISTRICT); AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS,

<br />on June 2,1987 the Zoning Commission of the City of San
<br />a public hearing regarding a request to change the zoning
<br />(Predevelopment District) to "c" (Commercial
<br />4.51 acres of land out of the L. Glassgow Survey, to
<br />San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said
<br />Commission did, on June 2,1987, consider said
<br />and voted to approve the same and has recommended
<br />request be approved by the City Council
<br />Ci ty ; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />TEXAS:

<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which was
<br />classified "PD" (Predevelopment District) upon its annexation to the
<br />City of San Marcos on July 28,1986, henceforth shall be zoned as
<br />"c" (Commercial District):

<br />BEING A PORTION OF THAT 9.37 ACRE TRACT OF LAND CONVEYED TO
<br />FRANK HOCH BY WELDON SCHLAMEUS BY DEED DATED JANUARY 24, 1953,
<br />AND RECORDED IN VOLUME 155, PAGE 196, HAYS COUNTY DEED RECORDS,
<br />AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
<br />FOLLOWS, TO-WIT:

<br />BEGINNING at an iron stake found at a corner fence post at the
<br />Northeast corner of the said Hoch 9.37 acre tract, for the
<br />Northeast corner of the tract herein described, same being at
<br />the Northwest corner of that 7.45 acre tract of land conveyed
<br />to John Avey by Cora M. Wills by deed dated May 10, 1949, and
<br />recorded in Volume 143, Page 600, Hays County Deed Records, and
<br />being on the South line of R.M. Highway No. 12, the South line
<br />of that 2.15 acre tract of land conveyed to the State of Texas
<br />by Weldon Schlameus by deed dated November 13, 1936 and recorded
<br />in Volume 112, Page 300, Hays County Deed Records, also being
<br />on the Northwest line of the Benjamin J. White Survey,
<br />the Southeast line of the L. Glasgow Survey, and from which a
<br />Texas Highway Department concrete monument found at
<br />Engineer's Centerline Station 660 + 22.5 bears S 87 degrees
<br />15' E, 74.30 feet;

<br />THENCE, leaving the said R.M. Highway No. 12, with fence, the
<br />said White-Glasgow Survey line, the following courses numbered
