<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING 22.8602 ACRES OUT OF THE JUAN MARTIN DE VERAMENDI
<br />LEAGUE NO.2, BEING A PORTION OF THAT CERTAIN 63.28 ACRE
<br />TRACT OF LAND CONVEYED TO LEMENS FINANCE COMPANY BY DEED
<br />RECORDED IN VOLUME 336, PAGE 12 IN THE DEED RECORDS OF
<br />HAYS COUNTY, TEXAS, LOCATED BETWEEN IH 35 NORTH AND RIVER
<br />ROAD NORTH OF THE MKT RAI LROAD "PD" (PREDEVELOPMENT
<br />DISTRICT) TO "MF-5" (MULTI-FAMI LY DISTRICT-HIGH DENSITY);
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on June 2,1987
<br />Marcos held a public hearing
<br />from "PD" (Predevelopment
<br />District-High Density) of
<br />Veramendi League No.2, to the
<br />and,
<br />
<br />the Zoning Commission of the City of San
<br />regarding a request to change the zoning
<br />District) to "MF-5" (Multi-Family
<br />22.8602 acres out of the Juan Martin De
<br />City of San Marcos, Hays County, Texas;
<br />
<br />WHEREAS, subsequent to said public hearing on said
<br />Commission did, on June 2, 1987, consider said
<br />and voted to approve the same and has recommended
<br />request be approved by the City Council

<br />WHEREAS, said City Council held a public hearing on the
<br />July, 1987, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which was
<br />classified "PD" (Predevelopment District) upon its annexation to the
<br />City of San Marcos on November 24,1980, henceforth shall be zoned
<br />as "MF-5 (Multi-Family District-High Density):
<br />
<br />Being a tract of land containing 22.8602 acres out of the Juan
<br />Martin De Veramendi League No.2, being a portion of that
<br />certain 63.28 acre tract of land conveyed to Lemens Finance
<br />Company by deed recorded in Volume 336, Page 12 in the Deed
<br />Records of Hays County, Texas, and being more particularly
<br />described by metes and bounds as follows:
<br />
<br />BEGINNING at an iron rod found at the most northerly corner of
<br />said Lemens Finance Company tract;
<br />
<br />THENCE S 41 degrees 09' 43" E, a distance of 142.21 feet to a
<br />nail found at a fence corner post;
<br />
<br />THENCE S 44 degrees 51' 50" E, a distance of 56.79 feet to an
<br />iron rod found at the most northerly corner of that certain
<br />4.983 acre tract of land conveyed to Edwin C. Mutschlechner by
<br />deed recorded in Volume 331, Page 472, Deed Records of Hays
<br />Coun ty;
<br />
<br />THENCE along the northwest line of said Mutschlechner tract the
<br />following two (2) courses and distances:
<br />
<br />1.) S 22 degrees 19' 52"W, 710.40 feet to an iron rod found;
<br />2.) S 32 degrees 14' 17"W, 130.78 feet to an iron rod found at
<br />the most westerly corner of said Mutschlechner tract;
<br />
<br />THENCE S 69 degrees 08' 27" E, a distance of 259.22 feet to an
<br />iron rod found at the most southerly corner of said
<br />Mutschlechner tract;
