<br />-2- <br /> <br />custody except that City agrees to deliver the boxes of <br /> <br />voted <br /> <br />ballots <br /> <br />to <br /> <br />County if requested tor canvass of the election or in the event the <br /> <br />voted ballots are required <br /> <br />for <br /> <br />any <br /> <br />court <br /> <br />proceedings in <br /> <br />which <br /> <br />the <br /> <br />County <br /> <br />may <br /> <br />be a party. <br /> <br />City agrees to maintain custody of the ballot <br /> <br />boxes containing the voted ballots after delivery by the <br /> <br />County <br /> <br />until <br /> <br />the <br /> <br />expiration <br /> <br />of sixty (60) days following the date of the election, <br /> <br />at which time City will dispose of <br /> <br />the <br /> <br />voted <br /> <br />ballots in <br /> <br />the <br /> <br />manner <br /> <br />prescribed <br /> <br />by <br /> <br />the <br /> <br />Texas <br /> <br />Election <br /> <br />Code and will return those ballot <br /> <br />boxes owned by County to the County. <br /> <br />IV. <br /> <br />Joint returns of the election <br /> <br />will be <br /> <br />provided by <br /> <br />the <br /> <br />Election <br /> <br />Judges <br /> <br />to <br /> <br />the <br /> <br />Mayor <br /> <br />and <br /> <br />County Judge and to the City Secretary and <br /> <br />County Election's Administrator. <br /> <br />All <br /> <br />returns by <br /> <br />Election <br /> <br />Officials <br /> <br />will <br /> <br />be <br /> <br />made <br /> <br />to <br /> <br />the <br /> <br />City and County at City Hall, 630 East Hopkins <br /> <br />Street, within said City following the closing of the <br /> <br />various <br /> <br />polling <br /> <br />places. <br /> <br />The <br /> <br />Mayor <br /> <br />of <br /> <br />the City and the City Secretary will maintain <br /> <br />custody of the returns until the completion of the election canvass <br /> <br />by <br /> <br />the City Council, after which City will deliver the original returns to <br /> <br />the County Courthouse for use by the Hays County Commissioners Court in <br /> <br />its <br /> <br />election <br /> <br />canvass. <br /> <br />County <br /> <br />agrees <br /> <br />to <br /> <br />maintain <br /> <br />custody <br /> <br />of the <br /> <br />election returns upon delivery by the City for a minimum <br /> <br />period of <br /> <br />60 <br /> <br />days following the date of the election. <br /> <br />County <br /> <br />also agrees to furnish City with the original records upon <br /> <br />request by the City in the <br /> <br />event <br /> <br />they <br /> <br />are <br /> <br />required <br /> <br />for <br /> <br />any <br /> <br />court <br /> <br />proceedings in which the City may be a party. <br /> <br />V. <br /> <br />To <br /> <br />facilitate <br /> <br />the <br /> <br />administration <br /> <br />of <br /> <br />the <br /> <br />election, <br /> <br />and <br /> <br />as a <br /> <br />convenience to the voters, during the <br /> <br />absentee <br /> <br />voting <br /> <br />period. <br /> <br />City <br /> <br />ag rees <br /> <br />to <br /> <br />designate <br /> <br />the County Election Administrator's Office, as a <br /> <br />Temporary Branch Absentee Polling Place for the City, and County agrees <br /> <br />to designate City Hall, 630 E. Hopkins, as a Temporary Branch <br /> <br />Absentee <br /> <br />Polling <br /> <br />Place <br /> <br />for <br /> <br />the <br /> <br />County <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />Section 85.062, <br /> <br />Election Code, V.T.C.A. <br /> <br />VI. <br /> <br />On Election Day, all forms used in the <br /> <br />conduct of <br /> <br />the <br /> <br />election, <br /> <br />including <br /> <br />but <br /> <br />not <br /> <br />limited to the poll list, signature roster, ballot <br />
