<br />161 <br /> <br />STATE OF TEXAS <br /> <br />JOINT ELECTION AGREEMENT <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br />That Hays County, a duly organized county in the State <br /> <br />of <br /> <br />Texas, <br /> <br />hereinafter <br /> <br />re ferred <br /> <br />to <br /> <br />as <br /> <br />the <br /> <br />"County", acting by and through its <br /> <br />County Judge on behalf of the Hays County Commissioners Court, and <br /> <br />the <br /> <br />City of San Marcos, a municipal corporation, hereinafter referred to as <br /> <br />the <br /> <br />"City" , <br /> <br />acting <br /> <br />by <br /> <br />and through its Mayor, enters into this Joint <br /> <br />Election Agreement pursuant to the terms and provisions <br /> <br />herein <br /> <br />s ta ted <br /> <br />and <br /> <br />pursuant <br /> <br />to <br /> <br />the <br /> <br />terms <br /> <br />of <br /> <br />the <br /> <br />Texas <br /> <br />Election <br /> <br />Code; <br /> <br />to-wit: <br /> <br />I. <br /> <br />County and City hereby agree jointly to hold special elections for <br /> <br />each political subdivision on Saturday, August 8, 1987 for the <br /> <br />purpose <br /> <br />of <br /> <br />considering <br /> <br />the <br /> <br />adoption of an additional one-half of one percent <br /> <br />local sales and use tax within each <br /> <br />government's <br /> <br />jurisdiction. <br /> <br />Said <br /> <br />joint <br /> <br />elections <br /> <br />will <br /> <br />be <br /> <br />held <br /> <br />at <br /> <br />the <br /> <br />same <br /> <br />polling places in each <br /> <br />precinct within the City as provided in that election ordinance adopted <br /> <br />by the San Marcos City Council on <br /> <br />July 7, <br /> <br />1987, a <br /> <br />copy 0 f <br /> <br />which <br /> <br />is <br /> <br />attached <br /> <br />hereto <br /> <br />and <br /> <br />incorporated <br /> <br />herein <br /> <br />by <br /> <br />re ference <br /> <br />as <br /> <br />thoug h <br /> <br />re-written herein in its entirety. <br /> <br />It <br /> <br />is <br /> <br />agreed that all expenses incurred in the administration of <br /> <br />the elections within the corporate limits of San Marcos, Texas, will be <br /> <br />shared equally by the County and City, <br /> <br />used <br /> <br />at <br /> <br />voting <br /> <br />sites <br /> <br />within <br /> <br />provided however, that should <br />ramps or similar items to be <br />corporate limits of said City be <br /> <br />construction <br /> <br />of voting signs, booths, <br /> <br />the <br /> <br />necessary, the agency providing the labor <br /> <br />for such <br /> <br />construction <br /> <br />will <br /> <br />be responsible for only one-third (1/3) of the cost of materials. <br /> <br />II. <br /> <br />It is agreed by the parties hereto that a common ballot and common <br /> <br />ballot boxes will be <br /> <br />used <br /> <br />for <br /> <br />the <br /> <br />joint <br /> <br />election, <br /> <br />to be <br /> <br />provided <br /> <br />equally by the two entities. <br /> <br />III. <br /> <br />The <br /> <br />ballot <br /> <br />boxes holding the voted ballots for the election will <br /> <br />be delivered by the Precinct Judges to the City Secretary at <br /> <br />the <br /> <br />City <br /> <br />Hall, <br /> <br />630 <br /> <br />East <br /> <br />Hopkins <br /> <br />Street, <br /> <br />and <br /> <br />said <br /> <br />boxes will remain in her <br />
