<br />-2- <br /> <br />seized. He is further authorized to provide, by <br />contract or otherwise, for the impoundment, storage <br />and sale of the property in any manner consistent <br />with this article that he may deem appropriate to <br />enforce its provisions. <br /> <br />Sec. 16-25. <br /> <br />Lien on impounded property. <br /> <br />A lien for all costs incurred in the <br />impounding, storing and advertising for sale of <br />personal property pursuant to this aritcle shall <br />exist and inure to the benefit of the City, and/or <br />in the event the property is impounded by an agent <br />for the City, to the per son, firm or corporation <br />actually impounding it. <br /> <br />Sec. 16-26. <br /> <br />Redemption of impounded property. <br /> <br />The owner or any person, firm or corporation <br />legally entitled to possession of any impounded <br />property as provided for in this article may redeem <br />it as follows: <br /> <br />(a) <br /> <br />Before sale. By paying to the City <br />and/or the actual impounder, before sale, <br />the impounding fee and any other actual <br />expenses incurred by the City and/or the <br />actual impounder in impounding property, <br />as determined by the fees set forth in <br />section 16-32. <br /> <br />(b) <br /> <br />After sale. By paying to the buyer at <br />the sale one and one-third ( 1 1/3) the <br />amount paid by him for the property, and <br />any reasonable expenses incurred by the <br />buyer for keeping it; provided, that the <br />property shall be redeemed from the buyer <br />wihin thirty (30) days after the date of <br />the sale, excluding the date of the sale, <br />otherwise title to the personal property <br />shall become absolute in the buyer. <br /> <br />Sec. 16-27. <br /> <br />Authority to se11. <br /> <br />When any property described in Section 16-22 <br />is not redeemed within ninety (90) days after being <br />impounded, it. may be sold by the city manager in <br />the manner provided by this ordinance. <br /> <br />Sec. 16-28. <br /> <br />Notice of sa1e. <br /> <br />Before sell ing any personal property as <br />provided for in this article, the City or actual <br />impounder shall post two (2) notices, one at the <br />Hays County Courthouse and one at the main entrance <br />of the City Hall and shall cause a copy to be <br />published in a newspaper regularly published in the <br />City of San Marcos once a week for two (2) <br />consecutive weeks, the date of the first <br />publication to be at least fourteen (14) days prior <br />to the date of the sale. The notice of the sale <br />shall describe the impounded property, state that <br />it is unredeemed, state that it will be sold, and <br />designate the place, manner, time and date of the <br />sale. <br />
