<br />AN ORnINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, N4ENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING MORE OR LESS TWO TRACTS CONSISTING OF TRACT 1:
<br />0.726 ACRES OUT OF THE J. M. VERAMENDI LEAGUE NO.
<br />TWO ALSO BEING A PORTION OF A 2.975 ACRE TRACT RECORDED IN
<br />VOLUME 298, PAGE 130 OF THE HAYS COUNTY, TEXAS DEED
<br />RECORDS AND TRACT 2: 2.249 ACRES OUT OF THE J.M. VERN~ENDI
<br />LEAGUE NO. TWO, SAID 2.249 ACRES ALSO BEING A PORTION
<br />OF A 2.975 ACRE TRACT RECORDED IN VOLUME 298, PAGE 130 OF
<br />THE HAYS COUNTY, TEXAS DEED RECORDS, LOCATED AT THE
<br />SOUTHWEST CORNER OF LOOP 82 AND WARDEN LANE FROM "M"
<br />(SINGLE, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO
<br />"c" (COMMERCIAL DISTRICT) AND "MF-5" (r.mLTI-FAMILY
<br />DISTRICT-HIGH DENSITY); AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on July 16,1987 the Planning and Zoning Commissions
<br />of the City of San Marcos held a public hearing regarding a request
<br />to change the zóning from "M" (Single, Duplex and Neighborhood Business
<br />District) to "C" (Commercial District) TRACT 1: 0.726 acres out
<br />of the J.M. Veramendi League No. Two and to "MF-5" (Multi-Family
<br />District-High Density) TRACT 2: 2.249 acres out of the J.M. Veramendi
<br />League No. Two to the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent
<br />Zoning Commission did,
<br />and voted to approve the
<br />request be approved
<br />Ci ty ; and,
<br />
<br />to said public hearing on said date, the
<br />on July 16,1987, consider said request
<br />same and has recommended that such
<br />by the City Council of said

<br />WHEREAS, said City Council held a public hearing on the
<br />August, 1987, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,

<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "M" (Single, Duplex and Neighborhood District) shall be rezoned
<br />"c" (Commercial District).

<br />RECORDS, SAID 0.726 ACRE TRACT BEING MORE PARTICULARLY DESCRIBED
<br />BY METES AND BOUNDS AS FOLLOWS:

<br />BEGINNING at a point on the South R.O.W. of U.S. Highway 81
<br />(Loop 82), said point being the North common corner of said
<br />2.975 acre tract and a 2904 square foot tract recorded in Volume
<br />244, Page 515 of the Hays County, Texas Deed Records for the
<br />Northwest corner of this tract and the POINT OF BEGINNING.
<br />
<br />THENCE N. 86 degrees 36' E., 309.07 feet to the intersection of
<br />the South R.O.W. of U.S. Highway 81 and Warden Lane, said point
<br />also being the Northeast corner of said 2.975 acre tract and
<br />this tract.
