<br /> <br />78 <br /> <br />ORDINANCE 1987-136 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 36, SAN MARCOS RIVER <br />CORRIDOR, OF THE SAN MARCOS CODE OF ORDINANCES BY <br />CORRECTING TYPOGRAPHICAL ERRORS, CLARIFYING REZONING <br />AND SITE PLAN REQUIREfli1ENTS, INCREASING THE IMPERVIOUS <br />COVER SETBACK, PROVIDING FOR REVIEW OF PLANS BY THE <br />DIRECTOR OF ENVIRONMENT AND ENGINEERING, INCLUDING <br />AUSTIN BASIN GUIDELINES, EXPANDING SAN MARCOS RIVER <br />CORRI DOR BOUNDARI ES, C LARI FYI NG ENGI NEERI NG <br />REQUIREMENTS, ESTABLISHING THE SITE PLAN SCALE AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. That Section 36-2(B)(1) is repealed and <br />is adopted in its place: <br /> <br />the <br /> <br />following <br /> <br />Sec. 36-2. <br /> <br />Application of Ordinance. <br /> <br />. . . <br /> <br />B. <br /> <br />Boundaries of the San Marcos River Corridor (SMRC). <br /> <br />(1) The boundaries of the SMRC shall be all land within an <br />area bounded by the headwaters of the San Marcos River <br />in Spring Lake along a line perpendicular to the flow <br />line of Sink Creek southeast to the intersection of the <br />Missouri Pacific Railroad tracks, then southwest along <br />the Missouri Pacific Railroad tracks to its intersection <br />wi th Bugg Lane, then sou theas t a long Bugg Lane to its <br />intersection with the Missouri Pacific Railroad <br />tracks, then southwest along those tracks to McKinnon <br />Street, then southeast along McKinnon Street to <br />its intersection with Field Street, then south along <br />Field Street to its in~ersection with Roberts Street, <br />then along Roberts Street, southeast along a line <br />crossing Interstate 35 to Sherbarb, along Sherbarb to <br />its intersection with Linda Lane, then southwest along <br />Linda Lane to its intersection with River Road, then <br />south along River Road to a point on River Road where <br />River Road turns northeast and intersects with land <br />having soil which is classified as having a high or <br />severe water erosion hazard, then southeast parallel <br />with the San Marcos River to the confluence of the <br />Blanco and San Marcos rivers, then for a distance of <br />1000 feet up the Blanco River and a distance of 200 feet <br />from the bank of the Blanco River, then across the <br />Blanco River to a point 200' from the eastern bank, then <br />south at a distance 200' from the bank to the flood <br />plain of the San Marcos River as defined in the <br />Watershed Plan and Environmental Impact statement, USDA, <br />SCS-EIS-WS- (ADM)-78-2-(F)-(TX), and on the Federal <br />Emergency Management Administration (FEMA) maps for <br />Hays, Guadalupe and Caldwell Counties in effect on the <br />effective date of the ordinance, (1) then along such <br />flood plain or (2) within one thousand (1000) feet of <br />the centerline of the San Marcos River if such land is <br />classified by the Soil Conservation Service Soil Surveys <br />of Hays, Caldwell and Guadalupe Counties, as having a <br />high or severe water erosion hazard, or (3) within two <br />hundred (200) feet of the bank of the San Marcos River, <br />whichever is the larger area, to the limits of San <br />Marcos' extraterritorial jurisdiction. <br /> <br />Then across the San Marcos River and from the San <br />Marcos' extraterritorial jurisdiction west and north <br />along the San Marcos River and (1) within the flood <br />plain of the San Marcos River or a tributary as defined <br />in the Watershed Plan and Environmental Impact <br />statement, USDA, SCS-EIS-WS-(ADM)-78-2(F)-(TX), and on <br />the Federal Emergency Management Administration (FEMA) <br />maps for Hays, Guadalupe and Caldwell Counties in effect <br />on the effective date of the ordinance, or (2) within <br />one thousand feet of the centerline of the San Marcos <br />River if such land is classified by the Soil <br />Conservation Service Soil Surveys of Hays, Caldwell and <br />
