<br /> <br /> <br /> <br />80 <br /> <br />ORDINANCE 1987- 138 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ARTICLE III, CHAPTER 5, FLOOD <br />DAMAGE PREVENTION ORDINANCE, OF THE SAN MARCOS CODE OF <br />ORDINANCES TO COMPLY WITH NEW FEMA REGULATIONS <br />REGARDING MANUFACTURED HOUSING AND MOBILE HOMES AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />BE <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />a PART 1: That Section 5-47 of the San Marcos Code of Ordinances is <br />amended by the addition of new subsection 9 as follows: <br /> <br />Se c. 5 - 47 . <br /> <br />De fini tions. <br /> <br />( 9 ) <br /> <br />Existing Manufactured Home Park or Manufactured Home <br />Subdivision- An organized developed property for the <br />placement and occupancy of manufactured homes, either <br />under a single unified ownership or subdivided by an <br />initial owner, which came into existence prior to the <br />adoption of the City's Floodplain Ordinance on November <br />25,1974. <br /> <br />PART 2. That subsections (9) through (28) of Section 5-47 of the <br />San Marcos Code of Ordinances are renumbered as Sections (10) <br />through (29) respectively. <br /> <br />PART 3. That Section 5-47(7) of the San Marcos Code of Ordinances <br />is repealed and the following adopted in its place. <br /> <br />. . . <br /> <br />(7) Elevated Building- means a nonbasement building (i) built, <br />in the case of a buildi'ng in Zones Al-30, AE, A, A99, AO, <br />AH, B, C, X, and D, to have the bottom of the lowest <br />horizontal structure member of the elevated floor elevated <br />above the ground level by means of pilings, colums (posts <br />and piers), or shear walls parallel to the floor of the <br />water and (ii) adequately anchord so as not to impair the <br />structural integrity of the building during a flood of up <br />to the magnitude of the base flood. In the case of Zones <br />AI-30, AE, A, A99, AO, AH, B, C, X, D, "elevated building" <br />also includes a building elevated by means of fill or solid <br />foundation perimeter wells with openings sufficient to <br />facilitate the unimpeded movement of flood waters. In the <br />case of Zones VI-3O, VE, or V, "elevated building" also <br />includes a building otherwise meeting the definition of <br />"elevated building", even though the lower area is enclosed <br />by means of breakaway walls if the breakaway walls meet the <br />standards of Section 60.3(e)(5) of the National Flood <br />Insurance Program regulations. <br /> <br />PART 4. That Section 5-16 of the San Marcos Code of <br />is amended by the addition of subsection (c) as follows: <br /> <br />Ordinances <br /> <br />Sec. 5-61. <br /> <br />Specific Standards For Construction. <br /> <br />c. <br /> <br />Enclosures- new construction and substantial improvements, <br />with fully enclosed areas below the lowest floor that are <br />subject to flooding shall be designed to automatically <br />equalize hydrostatic flood forces on exterior walls by <br />allowing for the entry and exit of floodwaters. Designs <br />for meeting this requirement must either be certified by a <br />registered professional engineer or architect or meet or <br />exceed the following minimum criteria: <br /> <br />(1) A minimum of two openings having a total net area of <br />not less than one square inch for every square foot of <br />enclosed area subject to flooding shall be provided. <br /> <br />(2) The bottom of all openings shall be no higher than <br />foot above grade. <br /> <br />one <br />
