3.06 Occupancy Restrictions. The following occupancy restrictions shall apply to residential <br />uses on this property: <br />a. All residential uses identified in Section 3.02 above shall be restricted to occupancy by a <br />family in accordance with the occupancy restrictions identified in Section 4.3.4.5 of the <br />City of San Marcos Land Development Code. <br />b. The provisions of this section shall be enforced through the residential lease agreements <br />and occupancy shall be based upon the lessee(s) indicated on the residential lease. <br />c. Duplex / Two - Family / Duplex Condominiums and Four Family (Quadraplex) or Three <br />Family (Tri -Plex) uses identified in Section 3.02 that do not meet the occupancy <br />restrictions identified within this section shall be subject to the requirements for a <br />Conditional Use Permit in accordance with the Land Development Code. <br />Part 4. Development Standards <br />4.01. Landscape Requirements. The Project Site shall contain a minimum of 25 <br />percent landscaping exclusive of any parkland /open space areas identified in <br />Section 4.11 below. Landscaping will include but is not limited to trees, shrubs, <br />grass, and native vegetation meeting the standards set forth in Chapter 6, Article <br />1, Division 1 of the City of San Marcos Land Development Code. The minimum <br />required landscaping will exceed the minimum 20 percent landscaping <br />requirements of Chapter 6, Article 1, Division 1 of the City of San Marcos Land <br />Development Code. <br />A minimum 205 foot natural greenbelt area shall be provided adjacent to the <br />south and west property boundaries adjacent to the Laurel Estates Subdivision, <br />the Willow Creek Estates Subdivision and the Gardens at Willow Creek <br />Subdivision. This greenbelt area is intended to provide for a buffer between the <br />adjacent low density residential subdivision and the Project Site and may be <br />counted towards the minimum required landscaping on the Project Site. The <br />natural greenbelt area will be privately owned and maintained by the Property <br />Owner. There shall be no construction of buildings or mass clearing or grading <br />within the natural greenbelt area without prior authorization and approval from <br />the City of San Marcos. Minimal clearing of the under canopy and underbrush <br />will be allowed to maintain a natural state of the greenbelt area. The natural <br />greenbelt area shall be maintained free of all trash, rubbish, debris or other <br />similar nuisances in accordance with the requirements of the City of San Marcos <br />Code of Ordinances. The provision of the 205 foot natural greenbelt area <br />exceeds the requirements of the Residential Compatibility Standards found in <br />Planned Development District 8 11/03/09The Retreat on Willow Creek <br />
