<br /> <br />fc-n <br /> <br />r-! <br /> <br />103 <br /> <br />ORDINANCE 1987- 141 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />CHAPTER 5, BUILDING CODE AND APPENDIX C, <br />SUBDIVISIONS OF THE SAN MARCOS CODE OF <br />ORDINANCES TO CLARIFY THE INTENT AND <br />LANGUAGE OF THE BUILDING CODE AND <br />SUBDIVISION ORDINANCE WITH RESPECT TO <br />PLATS, AND DECLARING AN EFFECTIVE DATE <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That Section 5-17 of the San Marcos Code of <br />Ordinances is repealed and the following adopted in its <br />place: <br /> <br />Sec. 5-17. Permits without approved plats. <br /> <br />A. No permit shall be issued for any building or <br />structure on a property for which a final plat has <br />not been approved and filed for record with the <br />following exceptions: <br /> <br />(1) Permits for single-family residences and <br />duplexes constructed prior to March 10, 1975 (the <br />date of adoption of the City of San Marcos <br />comprehensive subdivision ordinance) may be issued <br />if such permits are for accessory buildings, <br />additions, remodeling, repair or demolition or for <br />replacement of existing construction to be <br />demolished. However, there shall be an approved <br />and recorded plat prior to issuance of permits for <br />new, non-replacement single-family homes or <br />duplexes. <br /> <br />(2) Permits for multi-family residential or <br />non-residential remodeling or repair which: <br /> <br />(a) <br />(b) <br /> <br />Do not result in building expansion. <br /> <br />Do not cause a change in use which <br />resul ts in increased impact on the <br />City's infrastructure. <br /> <br />(c) <br /> <br />Are for buildings constructed prior <br />to March 10, 1975. <br /> <br />( 3) <br /> <br />Demolition permits. <br /> <br />B. A certificate of occupancy shall not be issued <br />for a building in any subdivision which was <br />subdivided on or after March 10, 1975, and in <br />which the standards contained in the Subdivis.ion <br />Ordinance of the City of San Marcos or in which the <br />standards or conditions pertaining to an approved <br />plat have not been met or are not. completed if the <br />uncompleted portion of such standards and <br />conditions adversely affect the building for which <br />the certificate of occupancy is sought. <br /> <br />COMMENTARY. A building permit may be issued <br />if the plat is approved and, if applicable, all <br />public improvements have been guaranteed. A <br />certificate of occupancy shall not be issued if the <br />public improvements to serve the building within a <br />subdivision with approved public improvements have <br />not been completed and accepted. Examples of <br />public improvements are streets, sewer and water <br />facilities, sidewalks, improvements required by any <br />required water pollution abatement plans, water <br />
