<br />-2- <br /> <br />quality detention and filtration systems, drainage <br />and erosion control facili ties, and drainage <br />facilities, all of which must be approved and <br />accepted, if applicable, by the City of San Marcos. <br /> <br />C. Any variance to these requirements may be <br />granted only by the Planning Conunission, or on <br />appeal, by the City Council. Such appeal must be <br />filed with the City Secretary within 30 days of the <br />Planning Conunission's action. <br /> <br />PART 2. That Article IV, Section G. of Appendix C, <br />Subdivisions of the San Marcos Code of Ordinances is repealed <br />and the following adopted in its place: <br /> <br />ARTICLE IV. LEGAL PROVISIONS <br /> <br />Section G. Requir888nts and restrictions. <br /> <br />1 . No owner of land wi thin the City limits <br />or the City's extraterritorial jurisdication shall <br />create a subdivision before a plat of such <br />subdivision has been approved by the Planning <br />Conmission and filed for record with the County <br />Clerk. <br /> <br />2. The following restrictions shall apply <br />regarding any property for which a final plat of a <br />subdi vision has not been approved and filed for <br />record if said plat was required at the time of <br />subdivision: <br /> <br />b. <br /> <br />c. <br /> <br />d. <br /> <br />a. <br /> <br />No permit shall be issued for <br />construction of any building or structure <br />except as provided by Section G.4. <br /> <br />No permit shall be issued <br />installation of a septic tank. <br /> <br />for <br /> <br />The City shall not install, maintain or <br />repair any public facility including but <br />not limited to street pavement, street <br />signs, sidewalks, water mains, sewer <br />mains or park land. <br /> <br />Neither the City nor any public utility <br />shall sell or supply, whether directly or <br />on a wholesale basis through an <br />intermediate supplier, any water, sewer, <br />gas or electrical service. <br /> <br />3. The following restriction shall apply <br />regarding any property for which a final plat of a <br />subdivision has been approved and filed for record <br />but required improvements have not been accepted or <br />required conditions have not been satisfied: <br /> <br />a. <br /> <br />b. <br /> <br />No certificate of occupancy shall <br />issued for building or structure. <br /> <br />be <br /> <br />Except on a specifically limited <br />temporary basis, for testing purposes, <br />construction purposes or to prevent <br />damage to a building, neither the City <br />nor any public utility company shall sell <br />or supply, whether directly or on a <br />wholesale basis through an intermediate <br />supplier, any water, sewer, gas or <br />electrical service. <br />
