<br /> <br /> <br /> <br />126 <br /> <br />ORDINANCE 1987-144 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />APPENDIX A, GENERAL ZONING ORDINANCE, OF <br />THE SAN MARCOS CODE OF ORDINANCES BY <br />EXPANDING THE PURPOSE PROVISIONS OF THE <br />ORDINANCE, CLARIFYING THE METHOD OF <br />CALCULATING THE AREA OF PROTBST FOR <br />ZONING CHANGES, REVISING PROVISIONS FOR <br />DURATION AND RENEWAL OF SPECIFIC USE <br />PERMITS, CLARIFYING THE DESCRIPTION OF <br />SIGHT-TRIANGLE, ADDING NEW OFF-STREET <br />PARKING REQUIREMENTS, DELETING CURB CUT <br />REQUIREMENTS, AND ESTABLISHING AN <br />EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That Section 1 of the General Zoning Ordinance <br />is repealed and the following adopted in its place: <br /> <br />Section 1. Purpose. <br /> <br />(A) For the purpose of promoting health, <br />safety, morals, and for the protection and <br />preservation of places and areas of historical, <br />cuI tural, or environmental significance, and the <br />general welfare of the community, it has been <br />deemed expedient and necessary to regulate and <br />restrict the height, number of stories, size of <br />buildings and other structures, the percentage of <br />the lot that may be occupied, the size of Ydrds, <br />courts and other open spaces, density of <br />population, the location and use of buildings, <br />structures, land designated to be used for <br />residential, commercial, trade, industry or other <br />purposes: and, in the case of designated places and <br />areas of historical and cultural importance, to <br />regulate and restrict the construction, alteration, <br />reconstruction or razing of buildings and other <br />structures. <br /> <br />(B) These regulations have been made with <br />reasonable consideration in accord with the Master <br />Plan, and are intended to be a means of <br />implementing the Master Plan where applicable, <br />bearing in mind the character of the district, its <br />peculiar suitability for particular uses, the <br />conservation of the value of buildings, and the <br />encouragement of the most appropriate use of the <br />land within the area. The paramount concern is to <br />lessen congestion in the streets: to secure safety <br />from fire, panic and other dangers: to promote the <br />health and general welfare of the citizens; to <br />provide adequate light and air: to prevent <br />overcrowding of land; to avoid undue concentration <br />of population: and to facilitate the adequate <br />provision of transportation, water, sewerage, <br />schools, parks, and other public requirements. <br /> <br />PART 2. Tha t Section 2 (D) ( 1 ) of the General Zoning <br />Ordinance is repealed and the following adopted in its place: <br /> <br />(D) <br /> <br />Protests and recommendations for denial.: <br /> <br />(1) <br /> <br />If a written protest against a <br />proposed zoning district boundary <br />
