<br />13. <br /> <br />14. <br /> <br />-7- <br /> <br />not conform with said regulations <br />and standards prescribed immediately <br />above shall be deemed a <br />nonconforming use and subject to the <br />terms and conditions of Section 39 <br />herein. When any nonconforming <br />structure is structurally altered, <br />adequate parking spaces which meet <br />the requirements of the regulations <br />and standards adopted herein shall <br />be required for the entire structure <br />and use. <br /> <br />No occupancy permit shall be issued <br />until the terms and condi tions of <br />this ordinance have been met, as <br />approved by the Chie f Building <br />Official. <br /> <br />All parking areas and parking spaces <br />shall be designed and constructed to <br />protect adjacent residences from the <br />direct glare of headlights of <br />vehicles using the parking area. <br />Where it is physically possile to do <br />so and accomplish the above-stated <br />purpose, all off-street parking <br />areas shall be effectively screened <br />on each side by a solid wall or <br />fence where adjacent to property <br />zoned for single-family or duplex <br />dwell ings . Except where it is <br />otherwise necessary to comply with <br />the sight-triangle requirements of <br />Section 36 (K) and (L), such wall or <br />fence shall not be less than four <br />(4) feet or more than six (6) feet <br />in height, shall be placed on the <br />property line, and shall be <br />maintained in good condition without <br />any advertising thereon. The space <br />between such wall or fence and the <br />lot line of any adjoining <br />residential property shall be <br />landscaped with grass, hardy shrubs <br />or evergreen ground cover. In lieu <br />of such wall or fence, a strip of <br />land not less than ten (10) feet in <br />width and planted and maintained <br />wi th an evergreen hedge, or dense <br />planting of evergreen shrubs, not <br />less than four (4) feet in height, <br />may be substituted. <br /> <br />PART 9. That the General Zoning Ordinance is amended <br />by the deletion of Exhibits A, Parking Design, Off Street <br />Parking and B, Entrance and Exit Curb Requirements. <br /> <br />PART 10. That Exhibit C, Paving Standards, of the <br />General Zoning Ordinance is deleted from Appendix A and <br />adopted as Article VI of Chapter 5 of the San Marcos Code of <br />Ordinances. <br /> <br />PART 11. Savings Clause: All sections, parts, words, <br />phrases, clauses, sentences or provisions of the San Marcos <br />General Zoning Ordinance which are repealed by this amending <br />ordinance shall remain valid and enforceable with regard to <br />any violation of any section, part, word, phrase, clause, <br />sentence or provision hereby repealed, if such violation <br />occurred prior to the effective date of this amending <br />ordinance. <br />
