5-1202.02 Any person violating any provisions of this ordinance shall become liable to the City for any expense, loss or damage occasioned by reason of such violation. Sec. 5-1300 Conflict with other ordinances Other ordinances or regulations of the City governing construction of streets or other public facilities remain applicable. Whenever the standards and specifications in this ordinance conflict with those contained in another ordinance, the most stringent or restrictive provisions shall govern, except that a Franchise Agreement shall always supersede this ordinance. Sec. 5-1400 Separability If any provision, section, subsection, sentence, clause or phrase of this ordinance, or the application of it to any person or set of circumstances, is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, the validity of the remainder of this ordinance, or of its application to other persons or sets of circumstances, shall not be affected. It is the intent of the City Council in adopting this ordinance that no portion of it or provision or regulation contained in it shall become inoperative or fail by reason of any unconstitutionality or invalidity of any other portion, provision or regulation. Part 2. That this ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
