<br />105.00 <br /> <br />106.00 <br /> <br />107.00 <br /> <br />104.01 <br /> <br />104.02 <br /> <br />May impose restrictions upon the timing of <br />construction which, in his opinion, are <br />reasonable measures to protect the safety and <br />convenience of the general public. <br /> <br />Shall prescribe the placement of barricades <br />and warning lights and signs which are, in <br />his opinion, reasonable measures to protect <br />the safety of the general public and of the <br />workers performing the construction. <br /> <br />If the Director of Public Works disapproves an <br />application for a public right-of-way construction <br />permit and denies it, the applicant shall be notified <br />of this action in writing via Certified Mail. This <br />notice shall include a statement of the reasons for <br />disapproval and denial. An application for a public <br />right-of-way construction permit may only be denied for <br />the following reasons, which are not subject to appeal. <br /> <br />105.01 <br /> <br />105.02 <br /> <br />The contents of the application do not <br />fulfill the requirements outlined in this <br />ordinance and/or as prescribed in the City of <br />San Marcos Right-of-Wa~ Construction Policies <br />and Procedures as promulgated by the Director <br />of Public Works. <br /> <br />The design and/or materials proposed for <br />execution of the construction do not meet the <br />standards prescribed in the City of San <br />Marcos Right-of-Way Construction Policies and <br />Procedures or the Manual for Design and <br />Construction. <br /> <br />Special provisions for holders of Franchise Agreements <br /> <br />106.01 <br /> <br />106.02 <br /> <br />106.03 <br /> <br />Bntex Gas Company, the San Marcos Telephone <br />Company, Karnack Cable Television Company and <br />such other entities with which the City of <br />San Marcos may enter into a Franchise <br />Agreement, are exempt from the permit fees <br />required in this Ordinance. <br /> <br />These entities shall comply with regulations <br />governing construction in the public right- <br />of-way, as' outlined in paragraph 105.02 <br />above. Said entities shall be afforded <br />thirty (30) calendar days to review and <br />comment upon any revisions to the <br />regulations. <br /> <br />Contractors performing construction permitted <br />as outlined in this section are exempt from <br />the provisions of Section 300 of this <br />ordinance. <br /> <br />Special procedures for emergency construction. <br /> <br />107.01 <br /> <br />107.02 <br /> <br />An emergency is defined for the purposes of <br />this ordinance to mean the interruption of a <br />public service, including electricity, <br />natural gas, telephone, water service, and <br />wastewater service, or any other circumstance <br />where prudent regard for the public safety <br />dictates that construction in the public <br />right-of-way be initiated at the earliest <br />opportunity. <br /> <br />Any person who initiates emergency <br />construction in a public right-of-way shall <br />notify the Police Department and the Fire <br />Department of the City of San Marcos before <br />initiating construction. <br /> <br />-2- <br />
