<br />Sec. 200 <br /> <br />107.03 <br /> <br />On the first working day following the <br />initiation of emergency construction, the <br />person initiating such construction shall <br />perform all actions prescribed by this <br />ordinance and/or by the regulations <br />promulgated pursuant to this ordinance for <br />issuance of a public right-of-way <br />construction permit. <br /> <br />Permit fees waived for publicly-sponsored construction. <br /> <br />Any appurtenant construction occasioned by projects sponsored by <br />the Texas Department of Highways and Public Transportation and/or <br />the City of San Marcos shall be exempt from the payment of permit <br />fees as prescribed herein. All other requirements for access <br />driveway permits and public right-of-way construction permits for <br />appurtenant construction shall be adhered to. <br /> <br />Sec. 300 <br /> <br />301.00 <br /> <br />302.00 <br /> <br />Sec. 400 <br /> <br />401.00 <br /> <br />402.00 <br /> <br />Sec. 500 <br /> <br />Construction Requirements <br /> <br />The Director of Public Works shall promulgate <br />requirements to be met by any contractors which perform <br />construction within public right-of-way. These <br />requirements shall include proof of adequate insurance <br />coverage and provision of a performance bond, as <br />specified in the construction specifications of the <br />City on the date when it is granted. <br /> <br />Evidence that the contractor who will perform the <br />construction meets the above requirements shall be <br />submitted as a part of the application for a public <br />right-of-way construction permit. <br /> <br />Penalties <br /> <br />Any person who violates any of the provisions of this <br />ordinance shall be guilty of a misdemeanor. Upon <br />conviction, said person shall be punished by a fine not <br />less than $200 or to exceed $1,000. Each day of <br />violation shall constitute a separate offense. <br />Prosecution or conviction under this provision shall <br />never be a bar to any other remedy or relief for <br />violations of this ordinance. <br /> <br />Other remedies <br /> <br />402.01 <br /> <br />Any person holding <br />construction permit <br />provisions of this <br />revocation of the <br />violated. <br /> <br />a public right-of-way <br />who violates any of the <br />ordinance is subject to <br />permit which is being <br /> <br />402.02 <br /> <br />Any person violating any provisions of this <br />ordinance is liable to the City for any <br />expense, loss or damage occasioned by reasons <br />of such violation. <br /> <br />Conflict with other ordinances. <br /> <br />Other ordinances or regulations of the City governing construction <br />of streets or other public facilities remain applicable. Whenever <br />the standards and specifications in this ordinance conflict with <br />those contained in another ordinance, the most stringent or <br />restrictive provisions shall govern, except that a Franchise <br />Agreement shall always supercede this ordinance. <br /> <br />Sec. 600 <br /> <br />Separability <br /> <br />If any provision, section, subsection, sentence, clause or phrase <br />of this ordinance, or the application of it to any person or set <br />of circumstances, is for any reason held to be invalid or <br /> <br />-3- <br />
