<br />LIABILITY FOR STREET CUTS <br /> <br />1 . <br /> <br />Except as noted below, the Utility or Contractor shall <br /> <br />be respcrnsible for maintaining all street cuts in such a <br /> <br />manner as to avoid a hazard to traffic and a nuisance to <br /> <br />residents until permanently repaired. <br /> <br />a. <br /> <br />When emergency repairs are deemed necessary by the City <br /> <br />Inspector, to correct a hazardous situation which is <br /> <br />obviously dangerous to the public, the <br /> <br />Utility/Contractor responsible for the cut shall be <br /> <br />notified immediately. <br /> <br />If the Utility/Contractor does <br /> <br />not respond to this emergency within one hour of being <br /> <br />notified, the repairs will be performed by City <br />personnel and the Utility/Contractor will be billed for <br /> <br />actual cost of all work necessary to complete the <br /> <br />project including clean-up as provided in Exhibit KA.. <br /> <br />b. <br /> <br />When City personnel are requested to make the permanent <br /> <br />repair, the Utility/Contractor will not be required to <br /> <br />maintain the cut repair for mare than two weeks from <br /> <br />the time of acceptance by the City Inspector. <br /> <br />c. <br /> <br />If the Utility is to make its own permanent repair. <br /> <br />then the cut must be maintained by the Utility until <br /> <br />such time as it is permanently repaired. <br /> <br />d. <br /> <br />All permanent repairs, whether performed by City <br /> <br />personnel or private utility, must be made within two <br /> <br />weeks of the time the backfill was accepted by the City <br /> <br />Inspector. <br /> <br />Failure to comply with this requirement <br /> <br />2 <br />
