69 ORDINANCE 1987-52 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ORDERING A SPECIAL RUNOFF ELECTION TO BE HELD WITHIN SAID CITY ON APRIL 25,1987, TO ELECT A CITY COUNCIL MEMBER PLACE THREE; ESTABLISHING THE RATE OF COMPENSATION TO BE PAID JUDGES AND CLERKS FOR SERVICES RENDERED DURING SAID ELECTION; MAKING PROVISIONS FOR THE CONDUCT OF SAID ELECTION AND OTHER PROVISIONS INCIDENT TO THE PURPOSES OF THIS ORDINANCE; AND, DECLARING AN EMERGENCY. WHEREAS, by ordinance duly adopted on January 12,1987, the City Council of the City of San Marcos, Texas, ordered the holding of special and joint general elections by said City and the San Marcos Consolidated Independent School District on April 4, 1987, and adopted certain other provisions relating thereto; and, WHEREAS, the two (2) candidates for City Council Member, Place Three, in the general election for said City received the same number of votes; and, WHEREAS, Section 5.05 of election by majority vote; and, the Charter of said City requires WHEREAS, the Texas Election Code, Section 2.021 requires a election in such circumstances; and, runoff WHEREAS, Section 5.05 of the Charter of said City requires that the runoff election be held three weeks after the preceding election; and, WHEREAS, Sections 2.026 and 4.003(b), V.T.C.A., Election Code require that notice of said runoff election be posted at City Hall not later than the 15th day before election day; and, WHEREAS, Section 4.003(a)(l), V.T.C.A., Election Code, requires that notice of said runoff election be published at least once in a newspaper in said City not later than ten (10) days before election day; now, therefore, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF MARCOS, TEXAS: THE CITY OF SAN SECTION 1. That a special runoff election for City Council Member, Place Three shall be held in said City on the 25th day of April 1987, to determine the winning candidate for said place. SECTION 2. That the election precincts for said election shall be, in all respects, the same precincts as those Hays County Election Precincts which are within the limits of the City of San Marcos. SECTION 3. Hopkins 44 Woods Homes Auditorium Thorpe Lane 16 Westover Baptist Church 46 Bishop and Advance Travis School Old Pos t Road SECTION 4. That the City Council of the City of San Marcos, Texas shall, on or before April 16,1987 by resolution duly adopted, appoint presiding judges and alternate judges to serve in said election at the
