<br /> <br /> <br /> <br />69 <br /> <br />ORDINANCE 1987-52 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ORDERING A SPECIAL RUNOFF ELECTION TO BE <br />HELD WITHIN SAID CITY ON APRIL 25,1987, TO ELECT A <br />CITY COUNCIL MEMBER PLACE THREE; ESTABLISHING THE RATE <br />OF COMPENSATION TO BE PAID JUDGES AND CLERKS FOR <br />SERVICES RENDERED DURING SAID ELECTION; MAKING <br />PROVISIONS FOR THE CONDUCT OF SAID ELECTION AND OTHER <br />PROVISIONS INCIDENT TO THE PURPOSES OF THIS ORDINANCE; <br />AND, DECLARING AN EMERGENCY. <br /> <br />WHEREAS, by ordinance duly adopted on January 12,1987, the City <br />Council of the City of San Marcos, Texas, ordered the holding of <br />special and joint general elections by said City and the San Marcos <br />Consolidated Independent School District on April 4, 1987, and adopted <br />certain other provisions relating thereto; and, <br /> <br />WHEREAS, the two (2) candidates for City Council Member, Place <br />Three, in the general election for said City received the same number <br />of votes; and, <br /> <br />WHEREAS, Section 5.05 of <br />election by majority vote; and, <br /> <br />the <br /> <br />Charter of <br /> <br />said <br /> <br />City <br /> <br />requires <br /> <br />WHEREAS, the Texas Election Code, Section 2.021 requires a <br />election in such circumstances; and, <br /> <br />runoff <br /> <br />WHEREAS, Section 5.05 of the Charter of said City requires that <br />the runoff election be held three weeks after the preceding election; <br />and, <br /> <br />WHEREAS, Sections 2.026 and 4.003(b), V.T.C.A., Election Code <br />require that notice of said runoff election be posted at City Hall not <br />later than the 15th day before election day; and, <br /> <br />WHEREAS, Section 4.003(a)(l), V.T.C.A., Election Code, requires <br />that notice of said runoff election be published at least once in a <br />newspaper in said City not later than ten (10) days before election <br />day; now, therefore, <br /> <br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF <br />MARCOS, TEXAS: <br /> <br />THE <br /> <br />CITY OF <br /> <br />SAN <br /> <br />SECTION 1. That a special runoff election for City Council <br />Member, Place Three shall be held in said City on the 25th day of April <br />1987, to determine the winning candidate for said place. <br /> <br />SECTION 2. That the election precincts for said election shall <br />be, in all respects, the same precincts as those Hays County Election <br />Precincts which are within the limits of the City of San Marcos. <br /> <br />SECTION 3.
