113. <br />Regular Meeting December 8, 2003 ' Page 6 <br /> <br />have been verified, more information is needed on 17 signs, 1 sign did not <br />exist on registration date and the remaining signs are in the process of <br /> <br />being researched. He stated the Planning and Development Department has <br />al'so inventoried signs on video. He stated some violations have been <br />found, and they are currently working with the Legal Department on a <br />notification letter. <br /> <br />Mayor Habingreither introduced a discussion regarding Building Contractor <br />Licensing Regulations for possible amendments to Contractor licensing. <br />Mr. O'Leary stated in February of 2002, the Council amended the Building <br />Contractor Licensing requirements. He stated following adoption of the <br />new regulations, the City received many complaints regarding the cost and <br />availability of insurance. He stated Staff was directed to delay <br />implementation of the new regulations until further research was <br />conducted. He also stated there is new Legislation, which goes into <br />effect in 2004. David McMillan, Chief Building Official, Stated House <br />Bill 730 regulates residential contractors. He also stated this Bill <br />requires contractors to provide warranties when bUilding a home. Mr. <br />Taylor stated currently the Ordinance requires a General Liability Policy, <br />which excludes poor workmanship. Mr. Thomaides stated he feels some <br />insurance should be required to help protect the homeowners. Mr. McMillan <br />stated the concerns are some contractors are not finishing jobs. Mr. <br />O'Leary stated the main complaints are not being able to afford this type <br />of insurance, which would be putting contractors out of business. Ms. <br />Narvaiz inquired as to Staff recommendations. Mr. McMillan stated he <br />feels the Council should wait to see what the State Licensing and <br />Regulations Board adopts. He also stated the current Ordinance needs to <br />be amended to correct errors. Mr. Mihalkanin inquired if there are other <br />concerned the contractors have. Mr. McMillan stated the contractors are <br />concern about being tested. He also stated he feels education and testing <br />would be helpful. Mr. Mihalkanin stated he feels the Ordinance should be <br />brought to Council on emergency in January. Ms. Narvaiz stated this is <br />not an attempt to burden contractors who are doing a good job. Mr. <br />McMillan stated he feels the testing requirements could be addressed by a <br />grandfathering clause. Mr. Taylor stated he would like to see a <br />reasonable grandfather clause be added regarding a contractor who has had <br />a license for 15 years or more. <br /> <br />Mayor Habingreither introduced a discussion regarding a proposed <br />Resolution opposing the U.S. Patriot Act. Mayor Habingreither stated <br />citizens have signed up to speak on this item. 1) Jim Green stated he <br />feels this Resolution is not in the purview of the City Council. He <br />encouraged the Council to leave this issue alone. 2) Dan Kowal stated he <br />is on the San Marcos Bill of Rights Defense Committee. He stated he <br />believes the Bill of Rights is the bedrock of our freedom. He stated the <br />Resolution does not oppose the U.S. Patriot Act, but affirms the Bill of <br />Rights. He encouraged the Council to support the Bill Of Rights and adopt <br />the Resolution as a community. Mr. Mihalkanin stated he feels the Council <br />needs to be careful about acting on issues which are not in their purview. <br />He stated he feels the Texas Bill of Rights provide more protection of <br /> <br /> <br />
