133. <br />Regular Meeting January 12, 2004 Page 7 <br />stated he wanted to clear up some miscommunication. If you have a license <br />then you will be grandfathered from testing. Mr. O'Leary stated Staff has <br />recommended the following changes to the Ordinance. 1. A contractor in <br />good standing and holding a current license issued prior to January 1, <br />2004, may renew his or her license without testing, if all other <br />contractor requirements in Chapter 14 of the City Ordinance are met. 2. A <br />person who has not held a license in oVer 12 months or kept current a <br />contractor's license will be required to take the ICC test. 3. A <br />contractor whose license has been suspended or revoked will be required to <br />take the appropriate ICC test for relicensure. 4. A contractor found <br />doing work other than emergency work without a license will be required to <br />take the ICC test and pay a penalty double the amount of the building <br />permit fee, but no less than $150.00. 5. Remove the three-permit rule for <br />out of town contractors as they can now submit plans and then test within <br />48 hours of being notified of the testing requirements. 6. The insurance <br />requirements should remain at $300,000.00 for a General Liability Policy <br />that includes Products and Completed Operations as one of the overages. <br />Ms. Narvaiz stated she feels this is a good compromise. Mr. Taylor stated <br />a reputable business will have no difficulty being insured, but new <br />contractors might have difficulty getting started. On roll call the <br />following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Thomaides, Mihalkanin, Habingreither, Montoya and Diaz. <br /> <br />NAY: Taylor. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RENAMING OF THE SAN MARCOS FIRE DEPARTMENT TO SAN <br />MARCOS FIRE AND RESCUE; AMENDING THE CITY CODE; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on.first reading and Mr. <br />Thomaides seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 34, ENVIRONMENT, OF THE CITY CODE TO ADD SECTION <br />34.106, PROHIBITING THE PLACEMENT OF FLYERS ON VEHICLES PARKED ON <br />PUBLIC STREETS IN THE DOWNTOWN AREA; INCLUDING PROCEDURAL PROVISIONS; <br />PROVIDING FOR PENALTIES; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on first reading and Mr. <br />Thomaides seconded the motion, which passed unanimously. <br /> <br /> <br />
