132. <br />Regular Meeting January 12, 2004 Page 6 <br /> CONSUMPTION OF ALCOHOLIC BEVERAGES FOR GOLD CROWN BILLIARDS AT 205A <br /> WEST SAN ANTONIO STREET; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. 1) Bob Thornton stated he is a Commissioner on the Planning and <br />Zoning Commission which originally heard this Specific Use Permit. He <br />stated the problems the Planning and Zoning Commission originally had, <br />have recently been corrected. He stated if this Specific Use Permit would <br />be sent back to the Planning and Zoning Commission, he feels the <br />Commission would support the Permit. 2) Marilyn Techen stated she is the <br />owner of Gold Crown Billiards. She stated she has made some significant <br />changes in management. She also stated she hopes the Council gives her <br />the opportunity to continue her business. Mayor Habingreither asked if <br />anyone else wished to speak. No one else did, so Mayor Habingreither <br />closed the public hearing. Mr. Montoya moved for adoption of the <br />Resolution and Mr. Mihalkanin seconded the motion. Mr. Montoya stated he <br />feels this SUP should be sent back to the Planning and Zoning Commission. <br />Ms. Narvaiz stated she agrees this SUP should be sent back to the Planning <br />and Zoning Commission. Mr. Mark Taylor stated Since the Public Hearing <br />has already been held, this item could be tabled and the Council could <br />direct staff to send this SUP back to the Planning and Zoning Commission. <br />Mr. Taylor moved to table the Resolution and Mr. Montoya seconded the <br />motion. Mr. Diaz stated he understands the previous manager is no longer <br />employed with Gold Crown Billiards. Ms. Techen stated she has hired a new <br />manager who has proven himself. Mr. Thomaides inquired as to the problems <br />the Planning and Zoning Commission had with Gold Crown Billiards' SUP <br />permit. Mr. Thornton, Chairman of Planning and Zoning Commission, stated <br />the previous problems the Planning and Zoning Commission had with the <br />extension of the SUP permit, was with the previous manager. Mr. Taylor <br />and Mr. Montoya withdrew their motion to table. Mr. Taylor moved to table <br />the Resolution and send the SUP permit back to the Planning and Zoning <br />Commission, and-Mr. Diaz seconded the motion. On roll call the following <br />vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Mihalkanin, Habingreither, Montoya, Diaz and Taylor. <br /> <br />NAY: Thomaides. <br /> <br />ABOVE: None. <br /> <br />Mayor Habingreither introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ARTICLE 11, LICENSING OF BUILDING CONTRACTORS, OF CHAPTER <br />14, BUILDINGS AND BUILDING REGULATIONS, OF THE SAN MARCOS CITY CODE, <br />TO REVISE AND CLARIFY BUILDING CONTRACTOR LICENSING REGULATIONS; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Ms. <br />Narvaiz seconded the motion.
