SECTION 2. Section 14.372 of the San Marcos City Code, is amended as follows (underlininq indicates added text, ~ indicates deleted text): Sec. 14.372. License required; exemptions; testinq requirements and exemptions from testinq ~. (a) It is unlawful for any person to perform construction work subject to this article unless the person is licensed as a contractor or is exempt from licensinq under one of the following: (1) A maintenance person may perform maintenance work only upon property owned by the person's employer. A maintenance person who performs work upon the property of more than one property owner is deemed to be performing work for the general public and shall be licensed as a city residential or general contractor. (2) A property owner may perform construction work with the owner's own hands in/on an existing residence owned and occupied by the owner as his homestead. All work is subject to permit, inspection and approval in accordance with this chapter. (b) A person must pass either the ICC-promulgated Residential contractor test or the ICC-promulgated General contractor test before receivinq a license, unless the person is exempt from testinq under one of the following: (1) A person holdinq a valid contractor's license on December 31, 2003 may renew the license without testinq, subject to all other requirements of this chapter, and may renew the license annually thereafter without testing, subiect to all other requirements of this chapter; or, (2) A person holdin.q a valid contractor's license based on passing a required test in another jurisdiction may renew the license annually without testing, subject to all other requirements of this chapter; or,
