Neither the city nor any city officer or employee <br />assumes any liability on the basis of an inspection activity or a license, certificate <br />or permit issued pursuant to this article or Article 12. <br /> <br /> SECTION 2. Section 14.372 of the San Marcos City Code, is amended as <br />follows (underlininq indicates added text, ~ indicates deleted text): <br /> <br />Sec. 14.372. License required; exemptions; testinq requirements and <br />exemptions from testinq ~. <br /> <br />(a) It is unlawful for any person to perform construction work subject to this <br />article unless the person is licensed as a contractor or is exempt from licensinq <br />under one of the following: <br /> <br /> (1) A maintenance person may perform maintenance work only upon <br />property owned by the person's employer. A maintenance person who performs <br />work upon the property of more than one property owner is deemed to be <br />performing work for the general public and shall be licensed as a city residential <br />or general contractor. <br /> <br /> (2) A property owner may perform construction work with the owner's own <br />hands in/on an existing residence owned and occupied by the owner as his <br />homestead. All work is subject to permit, inspection and approval in accordance <br />with this chapter. <br /> <br />(b) A person must pass either the ICC-promulgated Residential contractor test or <br />the ICC-promulgated General contractor test before receivinq a license, unless <br />the person is exempt from testinq under one of the following: <br /> <br /> (1) A person holdinq a valid contractor's license on December 31, 2003 <br />may renew the license without testinq, subject to all other requirements of this <br />chapter, and may renew the license annually thereafter without testing, subiect to <br />all other requirements of this chapter; or, <br /> <br /> (2) A person holdin.q a valid contractor's license based on passing a <br />required test in another jurisdiction may renew the license annually without <br />testing, subject to all other requirements of this chapter; or, <br /> <br /> <br />
