PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br />This Agreement is made this the 16th day of February, 2010, between the City of San <br />Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and C112M Hill, Inc., <br />("Engineer"), 12301 Research Boulevard, Building 4, Suite 250, Austin, Texas 78758 for the <br />provision of professional engineering services in connection with the Wastewater Treatment <br />Plant Site Location Assessment (the "Project"). <br />The City and the Engineer agree as follows: <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br />1.0 STANDARDS OF PERFORMANCE <br />1.0.1 The Engineer will be responsible for preparing a site location assessment for property on <br />which the City intends to locate a second Wastewater Treatment Plant (the "WWTP") in the <br />Cottonwood Creek watershed area of San Marcos east of Old Bastrop Highway. It is anticipated <br />that the initial average treatment capacity of this new WWTP will be eight (8) million gallons per <br />day (mgd) with a peak flow of 19.5 mgd. The Project includes assisting the City in making a <br />final determination of the preferred location for this WWTP so the City can begin land <br />acquisition activities. The work under this Project includes: <br />a) plant discharge permit limit evaluation; <br />b) flows and loads development; <br />c) liquid and solid treatment train process modeling; <br />d) plant sizing and footprint requirements; and <br />e) evaluation and integration of the WWTP with existing and planned wastewater <br />conveyance system improvements. <br />The Engineer will evaluate and rank four potential sites with the final recommended site being <br />determined using specific criteria developed in collaboration with the City. At a minimum, <br />these criteria will include proximity to the wastewater conveyance system and discharge site, <br />site accessibility, topography and geotechnical considerations, environmental considerations, <br />land costs and project capital costs. <br />1.0.2 The Engineer's Basic Services consist of the services described in Sections 1.0 through <br />1.8 and these services will be performed by the Engineer and the Engineer's subconsultant, Alan <br />Plummer Associates, Inc. <br />1.0.3 The performance of all services by the Engineer in connection with this Agreement will <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting disciplines. In performing all services under this Agreement, the <br />Engineer will use that degree of care and skill ordinarily exercised for similar projects by <br />professional Engineers who possess special expertise in the types of services involved under this <br />Agreement. <br />WWWTP Site Location Assessment -CH2M Hill <br />1
