and grease into the City's sanitary sewer system; establishing penalties for the <br />violation thereof; providing for publication; and providing an effective date. <br />MOTION: Upon a motion made by Councilmember Jones and a second by <br />Councilmember Couch, the City Council voted seven (7) for and none (0) opposed, to <br />approve the first reading of an ordinance amending Chapter 86, Article 3 of the San <br />Marcos City Code, establishing regulations governing the discharge of fats, oils and <br />grease into the City's sanitary sewer system. The motion carried unanimously. <br />23. Consider adoption of Resolution 2008-97R, approving the terms and conditions <br />of a letter agreement between the City and Denton, Navarro, Rocha & Bernal for <br />consulting services related to Police and Fire Department Meet and Confer <br />negotiations; and declaring an effective date. <br />MOTION: Upon a motion made by Councilmember Jones and a second by <br />Councilmember Guerrero, the City Council voted seven (7) for and none (0) opposed, to <br />approve Resolution 2008-97R, as previously captioned. The motion carried <br />unanimously. <br />24. Conduct Public Hearing and consider a motion to grant a variance to allow <br />issuance of a Conditional Use Permit for on-premise consumption of alcohol, in a <br />restaurant at 2550 Hunter Road that is less than 300 feet from a public school. <br />Mayor Narvaiz opened the Public Hearing at 9:03 p.m. There were no public comments, <br />and the Public Hearing was closed at 9:03 p.m. <br />MOTION: Upon a motion made by Councilmember Guerrero and a second by <br />Councilmember Couch, the City Council voted six (6) for and one (1) opposed, with <br />Councilmember Bose voting against, granting the variance allowing a Conditional Use <br />Permit for on-premise consumption of alcohol in a restaurant at 2550 Hunter Road that is <br />less than 300 feet from a public school. The motion carried. <br />25. Discussion on the recommendation of the Planning and Zoning Commission <br />re?ardin? the FY 2009-2018 Capital Improvements Plan. <br />Fred Terry, Planning and Zoning Chair, presented the FY 2009-2018 Capital <br />Improvements Plan. <br />26.
