~gal Department <br /> <br />mClllO <br /> <br />To: <br /> <br />From: <br /> <br />Subject: <br /> <br />Date: <br /> <br />Mayor Robert Habingreither and City Council Members <br /> <br />Charter Review Commission <br /> <br />Report of the 2003-04 Charter Review Commission <br /> <br />January 6, 2004 <br /> <br />The 2003-04 Charter Review Commission, appointed by the City Council in July of 2003, has <br />concluded its work, and presents this report to the City Council with recommendations for <br />amendments to the City Charter to be submitted to City voters for consideration in the May, 2004 <br />City election. <br /> <br />In each of the following revision proposals, underlining is used to indicate language proposed to be <br />added, and ~ indicates language proposed to be deleted. Each of the proposed changes in <br />the Charter text is followed by a brief statement of the Commission's rationale for proposing the <br />change. <br /> <br />It should be noted that although each of the proposed changes was approved by a majority of the <br />members of the Commission, several of the changes generated substantial debate and were not <br />supported by all members of the Commission, <br /> <br />A. SUBSTANTIVE REVISIONS <br /> <br />1. Amend Section 3.02(a)(2) regarding residence requirements for city council members as <br />follows: <br /> <br />Sec. 3.02. Qualifications. <br /> <br />(a) Each member of the city council, in addition to having other qualifications prescribed by <br />law: <br /> <br />(2) Shall have had his or her principal physical residence for at least one year <br /> preceding the election within the corporate limits of San Marcos; or shall have <br /> had his or her principal physical residence for a period of not less than one year <br /> immediately preceding the person's election, in any territory not formerly within <br /> the corporate limits of the city, but which is annexed under the provisions of <br /> <br /> 1 <br /> <br />City Hall o 630 East Hopkins · San Marcos, Texas 78666 ° 512/393-8150 · FAX 512/393-3983 <br /> <br /> <br />
