~gal Department mClllO To: From: Subject: Date: Mayor Robert Habingreither and City Council Members Charter Review Commission Report of the 2003-04 Charter Review Commission January 6, 2004 The 2003-04 Charter Review Commission, appointed by the City Council in July of 2003, has concluded its work, and presents this report to the City Council with recommendations for amendments to the City Charter to be submitted to City voters for consideration in the May, 2004 City election. In each of the following revision proposals, underlining is used to indicate language proposed to be added, and ~ indicates language proposed to be deleted. Each of the proposed changes in the Charter text is followed by a brief statement of the Commission's rationale for proposing the change. It should be noted that although each of the proposed changes was approved by a majority of the members of the Commission, several of the changes generated substantial debate and were not supported by all members of the Commission, A. SUBSTANTIVE REVISIONS 1. Amend Section 3.02(a)(2) regarding residence requirements for city council members as follows: Sec. 3.02. Qualifications. (a) Each member of the city council, in addition to having other qualifications prescribed by law: (2) Shall have had his or her principal physical residence for at least one year preceding the election within the corporate limits of San Marcos; or shall have had his or her principal physical residence for a period of not less than one year immediately preceding the person's election, in any territory not formerly within the corporate limits of the city, but which is annexed under the provisions of 1 City Hall o 630 East Hopkins · San Marcos, Texas 78666 ° 512/393-8150 · FAX 512/393-3983
