180. <br />Regular Meeting January 26, 2004 Page 4 <br />until the next Regular Meeting to be held on February 9, 2004. Mr. <br />Mihalkanin inquired as to the Charter Review Commission request of Item 7, <br />regarding the composition and qualifications of the Planning and Zoning <br />Commission. Mr. Hindson stated originally the composition and <br />qualifications of the Planning and Zoning Commission were in the City <br />Charter. He stated a previous Charter Review Commission recommended this <br />be in Ordinance form instead of in the City Charter. He stated the <br />current Charter Review Commission feels this should be in the City <br />Charter. Attached to these minutes is a copy of the Charter Review <br />Commission Report. <br /> <br />Mayor Habingreither introduced for consideration a public hearing, remove <br />from table and adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COI/NCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING EMISSION REDUCTION MEASURES IN CONNECTION WITH THE AUSTIN- <br />ROUND ROCK MSA EARLY ACTION COMPACT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. 1) Art Pedrosian stated he is the Chair of the Clean Air Force <br />Technology Advisory Committee. He stated heavy vehicles produce NOx and <br />18 wheelers produce even more NOx. He stated the Council needs to create <br />an Early Action Compact Plan before the EPA creates one for San Marcos. <br />2) Scott Johnson stated he supports the Plan. He feels by reducing NOx <br />and VOC, it will help with reducing illnesses. He stated he feels the <br />City need all measures in the Early Action Compact Plan. 3) Steve Rabbit <br />stated he feels the Council does not needs to adopt this Plan. He stated <br />he feels there will be no chance in losing highway funds. He also stated <br />heavy equipment diesel engines are a big part of the NOx and VOC problem, <br />and they are not required to be tested. 4) Vincent May read a paper <br />written by David Allen in 1999. He stated there has been a lot of <br />progress since 1999. He encouraged the Council to vote against this Plan. <br />He stated he also feels this Plan will put a lot of unnecessary expenses <br />on citizens. 5) Shelleen Walker stated she is from Travis County and is <br />on the Clean Air Force Committee. She stated the Mayor signed the EAC <br />Agreement on March 18, 2003 stating the City would help improve the air <br />quality. She encouraged the Council ~to approve the Plan as it is. 6) <br />Dianne Wassenich stated she feels the City cannot afford to lose any <br />highway funding. She stated if the Council does not approve the Plan, <br />then the City might lose out on economic development. 7) Mike Riley <br />stated he feels everyone wants clean air. He stated the EPA is <br />researching IM and they are pulling back on this subject because the <br />numbers are not being proven. He also stated IM is a short term solution. <br />8) Kathy Stephens stated she feels you do not get reductions for IM. She <br />also stated she feels most of the speakers are stating what is best for <br />the San Antonio area and not the Austin area. Mayor Habingreither asked <br />if anyone else wished to speak. No one did, so Mayor Habingreither closed <br />the public hearing. Mr. Mihalkanin moved to remove the Resolution from <br />the table and Ms. Narvaiz seconded the motion, which passed unanimously. <br />Mr. Mihalkanin moved for adoption of the Resolution and Ms. Narvaiz <br />seconded the motion. Mr. Mihalkanin asked David Allen for advice <br /> <br /> <br />
