206. <br />Regular Meeting February 9, 2004 Page 4 <br />he feels the buffer the developers are offering is not enough. He stated <br />one company has invested over $30 million, and he feels this does not make <br />sense to hurt industry. He also stated he feels this is not a good <br />proposal for this area. Ms. Narvaiz stated she agreed with Mr. <br />Mihalkanin. The Staff recommends denial and the Planning and Zoning <br />Commission voted 5 to 3 for approval upon the inclusion of the 150' wide <br />buffer. Ms. Barrett stated the Planning and Zoning Commission considered <br />the property in the rear as split into two properties. Mr. Thomaides <br />stated he agrees with Ms. Narvaiz and Mr. Mihalkanin. This is not good for <br />residents to be so close to Industry. Ms. Barrett stated this property is <br />designated as Industrial on the Future Land Use Map. She also stated she <br />knows it is important to have single family residence, but better planning <br />is needed. She also stated she feels the rear portion would be fine for <br />residential development. Ms. Narvaiz stated she feels the City should <br />consider contacting the owner about purchasing the property for Industrial <br />businesses. The Council agreed to by consensus to discuss this at a future <br />meeting. On roll call for adoption of the Resolution, the following vote <br />was recorded: <br /> <br />AYE: Diaz. <br /> <br />NAY: <br /> <br />Narvaiz, Thomaides, Mihalkanin, Habingreither, Montoya and <br />Taylor. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Habingreither introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO PROVIDE TIME <br />LIMITATIONS FOR ETHICS COMPLAINTS RELATED TO CITY COUNCIL MEMBERS; <br />INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES; AND <br />DECLARING AN EMERGENCY. <br /> <br />Ms. Narvaiz moved for adoption of the Ordinance on emergency and Mr. <br />Thomaides seconded the motion. Mayor Habingreither stated he would be <br />abstaining from Items 8-10. He and Mr. Taylor' left the Council Chambers. <br />Mr. Thomaides stated the Ethics Review Commission is important to the City <br />and this Ordinance is designed to provide protection to the Commission. <br />Mr. Mihalkanin stated if this Ordinance is adopted tonight, then this <br />cannot be retroactive on any complaints that have already been filed. Mr. <br />Mihalkanin moved to amend the Ordinance to be considered on three <br />readings, and Mr. Diaz seconded the motion. Mr. Montoya stated he <br />appreciates the hard work on these proposed changes. On roll call for <br />approval of Mr. Mihalkanin amendment~ the following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Thomaides, Mihalkanin, Montoya and Diaz. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Habingreither and Taylor. <br /> <br /> <br />
