Regular Meeting <br /> <br />February 23, 2004 <br /> <br /> 234. <br />Page 3 <br /> <br />Mayor Habingreither introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ORDERING A GENERAL AND SPECIAL ELECTION TO BE HELD ON MAY 15, 2004, <br />FOR THE PURPOSE OF ELECTING A MAYOR, A CITY COUNCIL MEMBER, PLACE 1, <br />A CITY COUNCIL MEMBER, PLACE 2, AND A CITY COUNCIL MEMBER, PLACE 3; <br />AND TO SUBMIT PROPOSITIONS TO THE VOTERS FOR PROPOSED AMENDMENTS TO <br />THE CITY CHARTER; ESTABLISHING EARLY VOTING LOCATIONS AND POLLING <br />PLACES FOR THIS ELECTION; MAKING PROVISIONS FOR THE CONDUCT OF THE <br />ELECTION; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Ms. <br />Narvaiz seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration approval of minutes of <br />the Regular Meeting held February 9, 2004, approval~of three Ordinances on <br />second reading, adoption of twelve Resolutions, and approval of Quarterly <br />Investment Report for the quarter ending December 30, 2003, on consensus. <br />The Council removed Items ~15, 16 and 22, adoption of Resolutions, to be <br />considered separately. Mr. Montoya moved for approval of minutes of the <br />Regular Meeting held February 9, 2004, approval of three Ordinances on <br />second reading, adoption of nine Resolutions, and approval of Quarterly <br />Investment Report for the quarter ending December 30, 2003, and Mr. <br />Mihalkanin seconded the motion, which passed unanimously. The caption of <br />these Ordinances and Resolutions read as follows: <br /> <br />Approval of Ordinances on second reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO PROVIDE FOR SPECIAL <br />COUNSEL FOR THE ETHICS REVIEW COP~ISSION; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO PROVIDE FOR <br />RESTRICTIONS ON COMMUNICATIONS WITH THE ETHICS REVIEW COMMISSION BY <br />PERSONS INVOLVED IN COMPLAINTS; INCLUDING PROCEDURAL PROVISIONS; <br />PROVIDING FOR PENALTIES; AND DECLARING AN EMERGENCY. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO PROVIDE TIME <br />LIMITATIONS FOR ETHICS COMPLAINTS RELATED TO CITY COUNCIL MEMBERS; <br />INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES; AND <br />DECLARING AN EMERGENCY. <br /> <br />Adoption of Resolutions: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RENEWAL OF THE LEASE WITH J.
