Regular Meeting <br /> <br />February 23, 2004 <br /> <br /> 236. <br />PaGe 5 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />DECLARING THE PUBLIC NECESSITY FOR ACQUISITION OF INTERESTS IN REAL <br />PROPERTY IN CONNECTION WITH THE POST ROAD PAVING AND DRAINING <br />IMPROVEMENTS PROJECT; AUTHORIZING NEGOTIATIONS FOR THE ACQUISITION OF <br />THESE INTERESTS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither introduced for consideration Item 15 removed from the <br />consent agenda, adoption a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, IN <br />DEFENSE OF THE BILL OF RIGHTS OF THE U.S. CONSTITUTION; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution and Ms. Narvaiz <br />seconded the motion. Mayor Habingreither stated citizens have signed up <br />to speak on this item. 1) Jim Green stated he opposes this Resolution. <br />He also stated placing a sign in the library would be confusing to <br />citizens. He stated he feels the Courts should deal with this issue, and <br />not the Council. 2) Dan Kowal stated he is a member of the San Marcos <br />Bill of Rights Defense Committee. He stated the Patiot Act provides <br />freedom of rights for citizens to have a free way of life. Voters elected <br />the Council and their judgment on issues to protect the citizens of San <br />Marcos. He encouraged the Council to support this Resolution. Ms. <br />Narvaiz stated she does not feel the Council should vote on national level <br />issues but would willing to take the Resolution with her to NLC if the <br />Council adopts the Resolution. Mr. Diaz stated he would like Ms. Narvaiz <br />to take this Resolution with her next week to the National League of <br />Cities Conference for their input. Mr. Mihalkanin stated he will support <br />this Resolution. Mr. Taylor stated he supports the Bill of Rights and <br />Constitution, but is concerned with parts of the Patriot Act. He stated <br />he feels this would be better addressed by State and Federal officials. <br />Mayor Habingreither stated he has struggled with this issue. He stated he <br />feels this issue might be politicized and would not be supporting this <br />Resolution. Mr. Thomaides stated he has also struggled with this <br />Resolution. He stated he feels citizens should tread cautiously when <br />dealing with national level issues. He also stated he will support this <br />Resolution. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Thomaides, Mihalkanin and Diaz. <br /> <br />NAY: <br /> <br />Narvaiz, Habingreither, Taylor and Montoya. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. <br /> <br />Mayor Habingreither introduced for consideration Item 16 removed from the <br />consent agenda, adoption a Resolution, the caption which was read as <br />follows: <br /> <br /> <br />
