263. <br /> <br />RESOLUTION NO. 2004- 39 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING A POLICY RELATED <br />TO THE RESALE OF TAX-FORECLOSED PROPERTIES; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br /> 1. Whereas, the City Council desires to enhance the efforts of Luanne .Caraway, Tax <br />Assessor-Collector of Hays County, Texas, to collect delinquent ad valorem property taxes; and <br /> <br /> 2. Whereas, from time to time certain real properties are offered for sale to the public by <br />the Constable, Precinct One, of Hays County, Texas, pursuant to Judicial Orders of the District <br />Courts of Hays County, Texas, for foreclosure of the tax liens securing payment of delinquent ad <br />valorem property taxes and accrued penalties, interest and costs; and <br /> <br /> 3. Whereas, from time to time, insufficient bids are received at these sales resulting in <br />the real properties being struck off to the various taxing jurisdictions of Hays County, Texas, <br />including the City of San Marcos; and <br /> <br /> 4. Whereas, the taxing jurisdictions desire to resell these real properties (the "Resale <br />Properties") in a fair, consistent and expeditious manner pursuant to Section 34.05 of the Texas <br />ProPerty Tax Code; now, therefore <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> PART 1. The City Council approves the following standards and procedures regarding <br />the sale of Resale Properties located within the taxing jurisdictions of Hays County, Texas, <br />pursuant to Section 34.05 of the Texas Property Tax Code: <br /> <br />(a) <br /> <br />The Resale Properties held in trust by the taxing jurisdictions shall remain in trust <br />until the appropriate redemption period, as defined by Section 34.21 of the Texas <br />Property Tax Code, has expired, unless a bid is received that meets the requirements <br />of (b) below. <br /> <br />(b) <br /> <br />During the 'redemption period, private bids may be received by the Hays County Tax <br />Assessor-Collector for Resale Properties. Any tendered bid during the redemption <br />period must be for 100% of the taxes, penalties, interest, attorney's fees and costs <br />due, or for the adjudged appraised value, whichever is less, or it shall be <br />automatically rejected. <br /> <br />(c) <br /> <br />Within six months after the expiration of the redemption period, a sale will be held <br />during which the Resale Properties will be placed up for resale by the taxing <br /> <br /> <br />
