<br />46 <br /> <br />regular meeting, march 19, 1979 <br /> <br />page two <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />ORDINANCE 1978-51, ADOPTED NOVEMBER 20, <br />1978, WHICH AMENDED CHAPTER 2 1/2 OF THE <br />CODE OF ORDINANCES OF THE CITY OF <br />SAN MARCOS, ENTITLED "ALCOHOLIC BEVERAGES" <br />BY PROVIDING FOR A NEW COMPREHENSIVE <br />LOCAL PUBLIC POLICY REGARDING THE <br />POSSESSION, SALE AND CONSUMPTION OF <br />ALCOHOLIC BEVERAGES; BY SPECIFYING <br />EXCEPTIONS TO CITY FEE REQUIREMENTS, THE <br />OFFICE TO WHOM FEE PAYMENTS ARE TO BE MADE, <br />AND CHANGING THE OFFICE WHICH KEEPS THE <br />RECORD OF FEE PAYMENTS; BY CHANGING THE <br />REQUIREMENT PERTAINING TO LOCATION WITHIN <br />THREE HUNDRED (300) FEET OF A RESIDENCE; BY <br />DELETING SETBACK REQUIREMENTS AND DIMENSIONS <br />TO PROVIDE FOR OUTDOOR SERVING AREAS; BY <br />CHANGING PERSON TO WHOM CONDITIONAL USE <br />PERMIT IS ISSUED; BY CHANGING PERSON TO <br />WHOM NOTICE OF VIOLATION IS GIVEN; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. Hansen moved the ordinance be approved on second reading. <br />Mr. Hyatt seconded the motion which passed unanimously. <br /> <br />The City Manager reported to the Council that the City had <br />received a high priority rating for an environmental protection <br />agency 75% construction grant for wastewater improvements. <br />Mr. Dunlap explained that the program would be carried out in <br />three phases and that for the first planning phase a consulting <br />engineer would need to be hired by the City. By common consent, <br />Council agreed to the Mayor's appointment of Council Members I <br />Breihan, Hansen, and Hyatt to a sub-committee to meet with the <br />City Manager and Director of Public Works to interview consulting <br />engineers. Mr. Hansen moved the Staff be authorized to proceed <br />\1ith the EPA application. Mr. Sutton seconded the motion which <br />passed unanimously. <br /> <br />Mayor Cavazos announced that Agenda Item #8, a request by the <br />Youth Service Bureau for funding, had been postponed at the <br />request of the Youth Service Bureau. <br /> <br />The Mayor read an ordinance having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />CHAPTER 29 OF THE CODE OF ORDINANCES, <br />ENTITLED "TRAFFIC" BY ADDING TO SECTION <br />29-122, ENTITLED "STOP SIGNS," OF <br />ARTICLE V, ENTITLED "TRAFFIC CONTROL <br />DEVICES" OF SAID CHAPTER, TWO LOCATIONS <br />FOR STOP SIGNS; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Hansen moved the ordinance be adopted as an emergency. <br />Mr. Hyatt seconded the motion which passed unanimously. <br /> <br />Mr. Hyatt moved that the next agenda item, a resolution approving I <br />a lease agreement for Lots 10 and II of the Municipal Airport <br />Subdivision to the San Marcos Chapter of the Order of Demolay be <br />tabled and referred to the Municipal Airport Commission for <br />study. Mr. James seconded the motion which passed unanimously. <br /> <br />The Mayor introduced for consideration award of bid on a pick-up <br />truck for the Utility Administration. Mr. Dunlap told the <br />Council that the Staff had begun to implement vehicle control <br />procedures as requested by the Council and that they wished to <br />transfer the used Utility Administration vehicle to the Parks <br />Department after repairs had been made.
