<br />50 <br /> <br />MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS, TEXAS, HELD MARCH 22, 1979 <br /> <br />Present: Mayor Robert L. Cavazos <br /> Council Members John Hansen <br /> Bob Hyatt <br /> Berry James <br />I Kenneth Sutton <br />City Manager Royal Dunlap <br />City Secretary Doriss Hambrick <br />City Attorney Barbara Jean Edwards <br />Absent: Council Member Ted Breihan <br /> <br />I <br /> <br />I <br /> <br />Also Present: Jeff Watkins, Ray Kotowski, Albert Sierra, Herman <br />Caviel, Gilbert Tenorio, Gary Bond, and Terry Roberts. <br /> <br />The Mayor called the meeting to order at 5:00 p.m. <br /> <br />The City Attorney informed the Council that a suit had been filed <br />against the City of San Marcos and the Planning and Zoning <br />Commission asking for a writ of mandamus to effect approval of <br />the final subdivision plat for Castle Forest Subdivision submitted <br />by Annco, Inc. Council Member James moved to continue discussion <br />of the lawsuit and executive session. Mr. Hansen seconded the <br />motion. Mr. Hyatt objected to meeting in executive session and <br />was supported in his contention that the matter be discussed in <br />open session by Mr. Sutton. On roll call, the following vote was <br />recorded: <br /> <br />AYE: <br />NAY: <br /> <br />James, Hansen, Cavazos <br />Hyatt, Sutton. <br /> <br />In view of the fact that the City Charter requires four affirmative <br />votes before any action may be taken, the motion was declared failed <br />Mr. Sutton suggested that Mr. Cavazos, Mr. James, and Mr. Hansen <br />meet during a recess, informally, with the City Attorney and <br />continue the meeting after the recess. Mr. Hyatt requested that the <br />Council reconsider the appeal for approval of Castle Forest <br />Subdivision. He was advised by the City Attorney that such recon- <br />sideration would have to be at a future meeting since the item had <br />not been placed on the special meeting agenda. Mr. Hyatt then <br />requested that a special meeting called for the earliest possible <br />time, possibly 7:30 p.m. that evening. No action was taken. . <br /> <br />The Mayor moved to adjourn the meeting and that he meet with the <br />Attorney and Council Member Hansen and James.
