<br />51 <br /> <br />MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS, TEXAS, HELD MARCH 22, 1979 <br /> <br />Present: Mayor Robert L. Cavazos <br /> Council Members John Hansen <br /> Bob Hyatt <br /> Berry R. James <br />I Kenneth E. Sutton <br />City Manager Royal Dunlap <br />City Secretary Doriss Hambrick <br />City Attorney Barbara Jean Edwards <br />Absent: Council Member Ted Breihan <br /> <br />I <br /> <br />I <br /> <br />Also Present: Chris Bishop, Alphonso Washington, Jeff Watkins, <br />Gilbert Tenorio, Randall Morris, Don Hyder, Tim Iammarino, Joe <br />Cox, Herman Caviel, Jerri Martin, and others. <br /> <br />The Mayor called the meeting to order at 7:30 p.m. <br /> <br />Council Member James read a prepared statement as follows: <br /> <br />"The City of San Marcos is faced with suits in the <br />Castle Forest Subdivision Plat approval. The City <br />has basically 3 alternatives. The first alternative <br />would be a possible change in the developer's plat, <br />which the developer's representative has refused to <br />consider. The second alternative would be for the <br />City to fight these actions in both State and <br />Federal Court. The City, the City Council, and <br />individually John Hansen, Robert Cavazos, and Berry <br />James, the Planning and Zoning Commission, and <br />individually the five members of the Planning and <br />Zoning on the prevailing side would need outside <br />legal counsel. Members of this City Council have <br />indicated opposition to employment of outside legal <br />counsel. In light of these' facts, the two above <br />alternatives do not seem open for consideration. <br />The third and final alternative is approval of the <br />Castle Forest Subdivision plat. Considering these <br />facts, and the financial position and implications <br />of this City and these individuals, we, Robert <br />Cavazos, Berry James, and John Hansen consider <br />approval of the Castle Forest Subdivision Plat." <br /> <br />Mr. Hyatt moved the Council overturn the Planning and Zoning <br />Commission's ruling denying approval of the Castle Forest <br />Subdivision so as to give Council approval to the final <br />subdivision plat for Castle Forest Subdivision.
