81) regular meeting, october 9 , 1978 page two Mr. Cavazos, after reading the ordinance, opened a public hearing to consider the zoning change request. The applicant, Dr. Pence Dacus, came before the Council to request the zoning change to build apartments. Among those objecting to the zoning change were Jerri Martin, Carmen Pardo, Martha Mercado, Mrs. Octavio Rivera and Concepcion Rodriguez. Mr. Hyatt, saying he had discussed the matter with the City Attorney since there were questions about ownership of adjacent property, moved to table the ordinance. Mr. James seconded the motion. After further discussion, Mr. Hyatt withdrew his motion with consent of the seconder. I Mr. Breihan moved to approve the ordinance on first reading. No second was made and the motion failed. Mr. Arredondo moved to deny the ordinance. Mr. Sutton seconded the motion. Mr. Hansen moved to table the ordinance. Mr. James seconded the motion. On roll call, the following vote was recorded: AYE: Breihan, Hansen, Cavazos, Hyatt, James NAY: Sutton, Arredondo. The Mayor Pro Tem read an ordinance in its entirety having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGU- LATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 3Z) BY CHANGING THE ZONING OF A TRACT OF LAND IN J. M. VERAMENDI LEAGUE #2, (FURTHER DESCRIBED BY METES AND BOUNDS ATTACHED), LOCATED AT 627 UHLAND ROAD, FROM "R-I" (SINGLE FAMILY RESIDENTIAL) TO "D" (MULTIFAMILY). I Mr. Handler Smith, the applicant, was present. He stated he was planning to build apartments. Neighbors living within 200 feet stated their opposition due to traffic increase, too much noise, and other reasons. Mr. Hansen moved this request be tabled until next Monday. Mr. Sutton seconded the motion. On roll call, the following vote was recorded: AYE: Breihan, Hansen, Hyatt, James, Sutton NAY: Arredondo. The staff was directed to contact those persons owriing property within 200 feet to determine whether or not they approved the change. Mr. Hyatt introduced for consideration a policy allowing use of City Park for travel trailer rallies. Mr. Arredondo moved the request be denied. Mr. Hansen seconded the motion. On roll call, the following vote was recorded: AYE: Hansen, Cavazos, Hyatt, James, Sutton, Arredondo NAY: Breihan. I Mr. Hyatt introduced for discussion a request for the sale of unused street right-of-way on C. M. Allen Parkway. Mr. Breihan suggested 13 feet of right-of-way behind the curb be saved in case it is needed. By common consent, the Council authorized staff to advertise for bidders.
