I ~ 2SdOOdO ~counCil Member \ yLn~J~ ohn T. ~<ans en ouncil Member ~R James Council Member I I regular meeting, october 9, 1978 page three 81 I Mr. Hyatt read an ordinance in its entirety having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION TWO OF THAT ORDINANCE WHICH PROVIDES FOR A JOB CLASSIFICATION AND SALARY SCHEDULE FOR THE PUBLIC SAFETY DIVISION OF THE CITY OF SAN MARCOS BY REVISING THE SALARY SCHEDULE. Mr. Sutton questioned some of the positions such as the Police Commander being paid lower than the sergeants. Mr. Sierra explained that due to overtime on the part of the sergeants, the Police Commander was sometimes paid less. He also asked why the rest of the City employees salaries were not listed on this ordinance. Mr. Sierra explained that only the civil service employees were re- quired to be listed on the ordinance due to the rules of the State. Mr. Cavazos moved the ordinance be adopted. Mr. Hansen seconded the motion, On roll call, the following vote was recorded: AYE: Cavazos, Hyatt, James, Arredondo, Breihan, Hansen NAY: Sutton. At 8:50 p.m., the Council recessed into executive session to discuss personnel, pending litigation and property acquisition on motion of Mr. Hyatt and second of Mr. Arredondo. The meet- ing reconvened at 10:00 p.m. on motion of Mr. Hansen and second of Mr. James. The Mayor reported that the Council had discussed potential landfill sites but no action was taken. Mr. Cavazos next reported the Council had discussed a suit filed in Federal Court by L. O. Backus against the City. Mr. Arredondo moved to authorize the City Attorney to contact the law firm of McGinnis, Lockridge and Kilgore to represent the City. Mr. Hansen second- ed the motion which passed unanimously. Mr. Arredondo next moved to authorize the staff to enter into discussion to retain the firm of Haskins and Sells to assist the City in considering the Entex, Inc. rates request. Mr. Hansen seconded the motion which passed unanimously. Mr. Cavazos then reported that the Council had discussed problems in paying accrued leave time to terminated employees and moved to freeze all vacant unclassified positions until the accrued time paid has been absorbed by the salary saved in leaving the position vacant. Mr. Sutton second- ed the motion. On roll call, the following vote was recorded: AYE: Breihan, Hansen, Cavazos, Hyatt, Sutton NAY: James. Mr. Cavazos informed staff and press that the Council would meet at 7:00 p.m., Monday, October 16, 1978 to evaluate the City Attorney. The meeting adjourned at 10:10 p.m. on motion of Mr. Breihan and second of Mr. Hansen.
