<br />130 <br /> <br />regular meeting, december 11, 1978 <br /> <br />page two <br /> <br />Mr. Breihan read a resolution having the following caption <br />and corrected the resolution to include a reference to <br />Blanco and Comal Counties in Part 2. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, <br />ENCOURAGING THE DESIGNATION OF RANCH <br />ROAD 12-32 AND HIGHWAY 1623 AS STATE <br />HIGHWAY 80 TO REACH FROM LULING THROUGH <br />SAN MARCOS AND BLANCO TO STONEWALL, <br />TEXAS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. Cavazos moved the resolution be adopted. Mr. Hansen <br />seconded the motion which passed unanimously. <br /> <br />The Mayor read an ordinance having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />CHAPTER 29 OF THE CODE OF ORDINANCES, <br />ENTITLED "TRAFFIC", BY DELETING TWO <br />SECTIONS FROM SECTION 29-122, ENTITLED <br />"STOP SIGNS", OF ARTICLE V, ENTITLED <br />"TRAFFIC CONTROL DEVICES", OF SAID <br />CHAPTER; BY ADDING TO SECTION 29-122, <br />ENTITLED "STOP SIGNS", OF THE AFORESAID <br />ARTICLE AND CHAPTER, TWO LOCATIONS FOR <br />STOP SIGNS; AND DECLARING AN EMERGENCY. <br /> <br />Mr. James moved the ordinance be adopted. Mr. Hansen <br />seconded the motion which passed unanimously. <br /> <br />Mr. James moved to take from the table an ordinance adopting <br />for prosecution purposes only those regulations approved by <br />the Southwest Texas State University Board of Regents I <br />pertaining to traffic control devices on its campus. <br />Mr. Hansen seconded the motion which passed unanimously. <br />Mr. Sutton restated his objection to approving the ordinance <br />since he felt that Exhibit A referred to in the ordinance <br />constituted abandonment of certain City streets. Mr. Hyatt <br />stated his contention that he felt the City should designate <br />traffic regulation on those streets owned by the City. <br />Mr. Ron Champion, Municipal Court Judge, explained to the <br />Council that the Texas Municipal League had advised him that <br />other cities did prosecute such cases in Municipal Court <br />without having taken similar action. Mr. Evans told the <br />Council that the University was able to set up traffic <br />regulations without having made any scientific study of the <br />situation and that he was concerned about potential liability <br />of the City in enforcing those regulations in Municipal Court. <br />Mr. Breihan agreed with Mr. Hyatt that the City should set <br />regulations for City owned streets and allow the University <br />to set regulations for traffic control only on University owned <br />property. Mr. Hyatt moved not to approve the ordinance. <br />Mr. Sutton seconded the motion. Council discussed the matter <br />further with Attorney Evans and Judge Champion. Mr. James <br />moved the ordinance be tabled. Mr. Arredondo seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />AYE: James, Arredondo <br />NAY: Breihan, Hansen, Cavazos, Hyatt, <br />Sutton. <br /> <br />I <br /> <br />The Mayor declared the motion failed. and called for a roll <br />call vote on the motion to not approve the ordinance. <br /> <br />AYE: Hansen, Cavazos, Hyatt, Sutton <br />Arredondo, Breihan <br />NAY: James. <br />
