A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ENCOURAGING THE DESIGNATION OF RANCH ROAD 12-32 AND HIGHWAY 1623 AS STATE HIGHWAY 80 TO REACH FROM LULING THROUGH SAN MARCOS AND BLANCO TO STONEWALL, TEXAS; AND DECLARING AN EFFECTIVE DATE. I Mr. Cavazos moved the resolution be adopted. Mr. Hansen seconded the motion which passed unanimously. The Mayor read an ordinance having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES, ENTITLED "TRAFFIC", BY DELETING TWO SECTIONS FROM SECTION 29-122, ENTITLED "STOP SIGNS", OF ARTICLE V, ENTITLED "TRAFFIC CONTROL DEVICES", OF SAID CHAPTER; BY ADDING TO SECTION 29-122, ENTITLED "STOP SIGNS", OF THE AFORESAID ARTICLE AND CHAPTER, TWO LOCATIONS FOR STOP SIGNS; AND DECLARING AN EMERGENCY. Mr. James moved the ordinance be adopted. Mr. Hansen seconded the motion which passed unanimously. Mr. James moved to take from the table an ordinance adopting for prosecution purposes only those regulations approved by the Southwest Texas State University Board of Regents I pertaining to traffic control devices on its campus. Mr. Hansen seconded the motion which passed unanimously. Mr. Sutton restated his objection to approving the ordinance since he felt that Exhibit A referred to in the ordinance constituted abandonment of certain City streets. Mr. Hyatt stated his contention that he felt the City should designate traffic regulation on those streets owned by the City. Mr. Ron Champion, Municipal Court Judge, explained to the Council that the Texas Municipal League had advised him that other cities did prosecute such cases in Municipal Court without having taken similar action. Mr. Evans told the Council that the University was able to set up traffic regulations without having made any scientific study of the situation and that he was concerned about potential liability of the City in enforcing those regulations in Municipal Court. Mr. Breihan agreed with Mr. Hyatt that the City should set regulations for City owned streets and allow the University to set regulations for traffic control only on University owned property. Mr. Hyatt moved not to approve the ordinance. Mr. Sutton seconded the motion. Council discussed the matter further with Attorney Evans and Judge Champion. Mr. James moved the ordinance be tabled. Mr. Arredondo seconded the motion. On roll call, the following vote was recorded: AYE: James, Arredondo NAY: Breihan, Hansen, Cavazos, Hyatt, Sutton. I The Mayor declared the motion failed. and called for a roll call vote on the motion to not approve the ordinance. AYE: Hansen, Cavazos, Hyatt, Sutton Arredondo, Breihan NAY: James.
