Mr. Sutton stated his contention that as many as four members of the Commission should be allowed to reside outside the City limits., After further discussion, Mr. Hansen withdrew his second of the Breihan motion which then failed for lack of a second. Mr. Hyatt moved to amend the ordinance to provide for a nine member Commission with three members being non-residents of the City. No second could be found for the motion. Mr. Arredondo moved to amend the ordinance to provide for a nine member Co~mission with two members allowed to be non-residents of the City and no I other residency requirements imposed. Mr. Hansen seconded the motion. Mr. Breihan said he felt the residency of the non-City members should be restricted in some manner. On roll call, the following vote was recorded: AYE: Hansen, Sutton, Arredondo NAY: Cavazos, Hyatt, James, Breihan. Mr. James moved to leave the ordinance as it was so as to provide for a seven member Commission. Mr. Cavazos seconded the motion. On roll call, the following vote was recorded: AYE: NAY: Cavazos, Hyatt, James Sutton, Arredondo, Breihan, H~nsen. The motion failed. Mr. Breihan moved to amend the ordinance to provide for a nine member Commission with two members allowed to be non-residents of the City but residents within the Capitol Area Planning Council Regt~~. The motion died for lack of a second. Mr. Hyatt moved to amend the ordinance to provide for a nine member Commission with one member allowed to be a non-resident of the City but a resident of Hays County and one member to be a resident of Caldwell County. Mr. Sutton seconded the motion. On roll call, the following vote was recorded: AYE: Hyatt, Sutton NAY: James, Arredondo, Breihan, Hansen, Cavazos. I Mr. Breihan moved to amend the ordinance to provide for a nine member Commission and to allow two members to be non-residents of the City but residents of either Hays or Caldwell County and that the ordinance be adopted on emergency. Mr. Hansen seconded the motion. On roll call, the following vote was recorded: AYE: NAY: Sutton, Arredondo, Breihan, Hansen James, Cavazos, Hyatt. Mayor Cavazos announced the nomination for appointments to the Airport Commission as follows: Dan Badwey, Bob Boyd, Allyn Gill, Ray S. Harper, Emmett McCoy, W. H. Moore, Harvey Shephard, Gordon Thompson, Donald Woten, and Howard Yeargan. Mr. Breihan moved the meeting be recessed to executive session at 7:55 p.m. to consider appointments. Mr. Hyatt seconded the motion which passed unanimously. The meeting reconvened at 8:10 p.m. on motion of Mr. Hyatt and second of Mr. Hansen. Mr. Sutton moved that Dan Badwey, Allyn Gill, Harvey Shephard, Howard I Yeargan, and Ray Harper be appointed to the Airport Commission to two year terms. Mr. Hansen seconded the motion which passed unanimously. The Mayor read the caption of an ordinance as follows: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, FIXING AND ORDERING THE RATES TO BE CHARGED BY ENTEX, INC., FOR GAS AND GAS SERVICE TO RESIDENTIAL AND COMMERCIAL CUSTOMERS WITHIN THE CITY OF SAN MARCOS, TEXAS; PROVIDING FOR THE FILING OF AN ANNUAL OPERATING REPORT; PLACING CERTAIN FILING LIMITATIONS; ESTABLISHING THE EFFECTIVE DATE THEREOF; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING SEVERABILITY.
