Mr. Sutton stated his contention that as many as <br />four members of the Commission should be allowed to reside <br />outside the City limits., After further discussion, <br />Mr. Hansen withdrew his second of the Breihan motion which <br />then failed for lack of a second. Mr. Hyatt moved to amend <br />the ordinance to provide for a nine member Commission with <br />three members being non-residents of the City. No second <br />could be found for the motion. Mr. Arredondo moved to amend <br />the ordinance to provide for a nine member Co~mission with <br />two members allowed to be non-residents of the City and no I <br />other residency requirements imposed. Mr. Hansen seconded <br />the motion. Mr. Breihan said he felt the residency of the <br />non-City members should be restricted in some manner. On <br />roll call, the following vote was recorded: <br /> <br />AYE: Hansen, Sutton, Arredondo <br />NAY: Cavazos, Hyatt, James, Breihan. <br /> <br />Mr. James moved to leave the ordinance as it was so as to <br />provide for a seven member Commission. Mr. Cavazos seconded <br />the motion. On roll call, the following vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Cavazos, Hyatt, James <br />Sutton, Arredondo, Breihan, H~nsen. <br /> <br />The motion failed. Mr. Breihan moved to amend the ordinance <br />to provide for a nine member Commission with two members <br />allowed to be non-residents of the City but residents within <br />the Capitol Area Planning Council Regt~~. The motion died <br />for lack of a second. Mr. Hyatt moved to amend the ordinance <br />to provide for a nine member Commission with one member allowed <br />to be a non-resident of the City but a resident of Hays County <br />and one member to be a resident of Caldwell County. Mr. Sutton <br />seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: Hyatt, Sutton <br />NAY: James, Arredondo, Breihan, Hansen, <br />Cavazos. <br /> <br />I <br /> <br />Mr. Breihan moved to amend the ordinance to provide for a nine <br />member Commission and to allow two members to be non-residents <br />of the City but residents of either Hays or Caldwell County <br />and that the ordinance be adopted on emergency. Mr. Hansen <br />seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Sutton, Arredondo, Breihan, Hansen <br />James, Cavazos, Hyatt. <br /> <br />Mayor Cavazos announced the nomination for appointments to the <br />Airport Commission as follows: Dan Badwey, Bob Boyd, Allyn <br />Gill, Ray S. Harper, Emmett McCoy, W. H. Moore, Harvey Shephard, <br />Gordon Thompson, Donald Woten, and Howard Yeargan. Mr. Breihan <br />moved the meeting be recessed to executive session at 7:55 p.m. <br />to consider appointments. Mr. Hyatt seconded the motion which <br />passed unanimously. The meeting reconvened at 8:10 p.m. on <br />motion of Mr. Hyatt and second of Mr. Hansen. Mr. Sutton <br />moved that Dan Badwey, Allyn Gill, Harvey Shephard, Howard I <br />Yeargan, and Ray Harper be appointed to the Airport Commission <br />to two year terms. Mr. Hansen seconded the motion which <br />passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, <br />FIXING AND ORDERING THE RATES TO BE CHARGED BY <br />ENTEX, INC., FOR GAS AND GAS SERVICE TO <br />RESIDENTIAL AND COMMERCIAL CUSTOMERS WITHIN THE <br />CITY OF SAN MARCOS, TEXAS; PROVIDING FOR THE <br />FILING OF AN ANNUAL OPERATING REPORT; PLACING <br />CERTAIN FILING LIMITATIONS; ESTABLISHING THE <br />EFFECTIVE DATE THEREOF; REPEALING ALL ORDINANCES <br />IN CONFLICT HEREWITH; AND PROVIDING SEVERABILITY. <br />
