Mr. Hansen seconded the motion, which passed unanimously. The Mayor read the caption of an Ordinance as follows: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, BY ADDING A NEW CHAPrER NUMBERED 32, ENTITLED "FAIR HOUSING" SO AS TO DECLARE AND ESTABLISH THE POLICY OF THE CITY TO FURTHER THE RIGHT OF EACH INDIVIDUAL TO PROVIDE A DWELLING FOR SUCH PERSON AND/OR SUCH PERSON'S FAMILY, INCLUDING THE FINANCING THEREOF vITTHOUT REGARD TO SEX, RACE, COLOR, RELIGION, OR NATIONAL ORIGIN; ADOPl'ING REGULATIONS FOR BROKERAGE SERVICES PROHIBITING DISCRIMINATION BASED ON SEX, RACE, COLOR, RELIGION, OR NATIONAL ORIGIN; PROHIBITING INTIMIDATION; PROVIDING FOR CERl'AIN EXEMPl'IONS AND EXCLUSIONS;, ESTABLISHING A PROCEDURE FOR THE HA1~LING OF COMPLAINTS; OUTLINING THE DUTIES OF THE FAIR HOUSING OFFICER; PROVIDING FOR THE CREATION OF A FAIR HOUSING COMMISSION WITHIN THE CITY OF SAN MARCOS; PROVIDING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THSI ORDINANCE; CLARIFYING CONFLICTING ORDINANCES; PROVIDING FOR A SAVINGS CLAUSE; PROVIDIKG AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE. Mr. Sutton moved approval of the Ordinance on second reading. Mr. Hansen seconded the motion. On roll call, the following vote was recorded: AYE: Arredondo, Cavazos, Craddock, Hansen, Sutton NAY: Breihan. At 8:25 p.m. Mr. Arredondo moved to recess to executive session to discuss pending litigation. Mr. Hansen seconded the motion, which passed unanimously. The Council reconvened in regular session at 9:05 p.m. on motion of Mr. Cavazos and second of Mr. Breihan. Mayor Craddock reported that the Council had discussed two cases pending: the Texas Water Quality Board suit alleging violations over the Edwards A~uifer and a zoning case at 80~ West Hopkins Street. Mr. Cavazos moved that in the litie;ation regarding the zoning case to allow for due process of law. Mr. Sutton seconded the motion, which passed unanimously.
