<br />77 <br /> <br />REGULAR MEEl'ING OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, JULY 26, 1976 <br /> <br />Present: <br /> <br />Mayor <br /> <br />Emmie Craddock <br /> <br />Councilmen <br /> <br />Frank T. Arredondo <br />Ted Breihan <br />Robert L. Cavazos <br />John Hansen <br />Berry R. James <br />Kenneth E. Sutton <br /> <br />I <br /> <br />City Manager <br />City Secretary <br />Director of Public Works <br />Director of Finance <br /> <br />James B. Baugh <br />Doriss Hambrick <br />William T. Friedrich <br />Earl T. Williams <br /> <br />Also present: Charles Evans; Samuel F. Johnson; Sally Parker; Vera Schubert; <br />Jim Pendergast; Patrick Price; H.Y. Price, Jr.; Tom Bond; <br />David Parkhill; Bob Derrick; Jim Alvis; Melissa Millecam; Jerri <br />Martin; Terry Roberts; Gary Bond; Rowe Ray; and others. <br /> <br />The Mayor called the meeting to order at 7:30 p.m. <br /> <br />The Minutes of the Regular Meeting held July 12, 1976 were approved on motion of <br />Mr. Cavazos and second of Mr. James. The Minutes of the Special Meetings held <br />July 16 and July 19 were approved on motion of Mr. Hansen and second of Mr. James. <br /> <br />I <br /> <br />The Mayor opened a Public Hearing to consider a request for a change in the zoning <br />of part of Lot 14, Block 3 of the Lindsey and Harvey Addition from "D" to "P-2". <br />Present to request the change on behalf of the Christian Science Society were <br />Samuel F. Johnson, chairman of the Building Committee, and Sally Parker and Vera <br />Schubert. No objections were received. The Mayor closed the hearing and read an <br />ordinance having the following caption: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 <br />(VOL. 32) BY CHANGING THE ZONING OF PART OF LOT 14, BLOCK 3 OF THE LINDSEY AND <br />HARVEY ADDITION, LOCATED AT 525 W. HUTCHISON STREEI', FROM "D" (MULTIFAMILY) <br />TO IP_2" (PUBLIC). <br /> <br />Mr. Hansen moved the Ordinance be approved on first reading. Mr. Cavazos seconded <br />the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration a request from Herbert Rizk for a temporary <br />perIni t to locate a mobile home on Lot 1, Block 5 of the Victory Gardens Addition, <br />227 Roosevelt Street. Mayor Craddock reported that the Planning and Zoning <br />Commission had recommended approval of the request, but that a petition of objection <br />had been presented subseq~ent to their recommendation from Mrs. Petra Reyes, owner <br />of property within 200 feet of the property in question. Mr. Cavazos moved the <br />request be denied. Mr. Hansen seconded the motion, which passed unanimously. <br /> <br />The Mayor read an Ordinance, the caption of which is as follows: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CLOSING <br />AND ABANDONING A PORTION OF MOON STREET IN THE ORIGINAL TOWN OF SAN MARCOS, <br />TEXAS, RELINQUISHING TO BILLY J. CLARKE, DR. STANDLY AULT, AND A.A. ROOS III, <br />ALL RIGHT, TITLE AND INTEREST OF THE CITY OF SAN MARCOS, TEXAS, IN AND TO <br />SAID PORTION OF MOON STREET, AND DIRECTING THE MAYOR TO EXECUTE AND DELIVER <br />TO SAID PERSONS QUITCLAIM DEEDS TO THE PORTION OF MOON STREET ADJOINING <br />THEIR PROPERTY. <br /> <br />The City Manager reported that the Planning and Zoning Commission and the citJ. <br />staff recommended denial of this request to aoandon city property due to the facts <br />that there are active water and sewer lines em the property as well as an historical <br />marker. Mr. Breihan moved the Ordinance not be approved. Mr. Cavazos secondE!d the <br />motion, which passed unanimously. <br />
