. RESOLUTION NO. 2010-52R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ESTABLISHING A RISK POOL PURSUANT TO <br />CHAPTER 172 OF THE TEXAS LOCAL GOVERNMENT CODE; <br />AUTHORIZING THE PARTICIPATION OF THE SAN MARCOS AREA <br />CHAMBER OF COMMERCE IN THE RISK POOL; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE <br />GREATER SAN MARCOS AREA CHAMBER OF COMMERCE <br />SETTING FORTH THE TERMS AND CONDITIONS OF <br />PARTICIPATION IN THE RISK POOL; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. Pursuant to Section 172.001 et seq. of the Texas Local Government Code (the <br />"Act'), the City of San Marcos (the "City) directly or through a risk pool may provide health and <br />accident coverage for its officials, employees, and retirees, or any class of officials, employees, <br />or retirees, and employees of eligible affiliated service contractors ( "ASC ") qualified for <br />exemption under Section 501 (c) of the Internal Revenue Code. <br />2. The San Marcos Area Chamber of Commerce (the "Chamber ") is an eligible <br />• affiliated service contractor that receives funding from the City of San Marcos, a portion of <br />which funding is applied toward employee health insurance coverage and similar benefits. <br />3. Cost savings associated with health insurance and similar benefits will be <br />achieved by enabling the Chamber to participate in a risk pool and benefit programs created by <br />the City, thereby reducing the amount of funding provided to the Chamber annually. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. That the City of San Marcos hereby establishes the City of San Marcos <br />Employee Benefits (the "Pool "). The Pool shall be governed and subject to the requirements of <br />the Act. The name of the Pool may be changed from time to time by the City. <br />PART 2. That the supervision and administration of the Pool shall be as follows: <br />A. The Pool shall be supervised by trustees ( "Trustees ") comprised of the <br />following persons: <br />1. Director of Human Resources; <br />2. Assistant Director of Human Resources; and <br />3. Director of Finance. <br />41 B. The Pool shall be administered by the Director of Human Resources. <br />
