136 REGULAR MEErING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, DECEMBER 13,1976 Present: Mayor Emmie Craddock Councilmen Frank T. Arredonilo Ted Breihan Robert L. Marshall; Mrs. Richard Bowles; Dr. Francis Horne; Dr. Everett Swinney; John Dennison; Jimmy McCloud; Senator Charles Herring; Bob Davis; Griffith Morris; Frank Seifert; Shirley Wickersham; Jilll Pendergast; Jerri Martin; Melissa Millecam; Rowe Ray; and others. The Mayor called the meeting to order at 7:30 p.m. The Minutes of the Regular Meeting held November 22, 1976 were approved on motion of Mr. Hansen and second of Mr. James. The Minutes of the Special Meeting held November 29, 1976 were approved on motion of Mr. Hansen and second of Mr. James. I Mrs. C.D. Marshall and Mrs. Richard Bowles came before the Council to announce that Balcones Garden Club had arranged for trees and other smaller plants to be donated to landscaping the new city hall grounds. Mrs. Marshall informed the Council that 33 liveoak trees had been purchased by elementary school students and that other persons were donating trees to recognize city manager James Baugh, former city secretary Dorothy O. Worrell and former Mayor Luciano Flores. The Mayor thanked Mrs. Marshall and Mrs. Bowles and presented them with a certificate of appreciation to the Balcones Garden Club. The Mayor opened a Public Hearing to consider a request for a change in the zoning of part of Lots 17 and 18, Block 4 of the D.P. Hopkins Addition from "D" to "M". The applicant, Art Ables, was not present. No persons came forward to object to the requested change. Mayor Craddock announced that petitions had been received both in approval of and objection to the change and that the Planning and Zoning Commission had recommended the change not be approved. The Mayor closed the hearing and read an Ordinance, the caption of. which is as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF .SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF PART OF LOTS 17 AND 18, BLOCK 4 OF THE D.P. HOPKINS ADDITION, LOCATED AT THE SOUTHEAST CORNER OF THE LINDSEY AND NORTH STREET INTERSECTION, FROM "D" (MULTIFAMILY) TO "M" (MIXED). I Mr. Sutton moved the Ordinance not be approved. Mr. Arredondo seconded the w)tion. Mr. Sutton cited his reason for objection to "he change was the poor traffic condition in the area. On roll call, the following vote~s recorded: AYE: Craddock, Hansen, James, Sutton, Arredondo, Cavazos NAY: Breihan. The Mayor opened a 'Ji'ublic Hearing to discuss the electric rate retail structu.re for San Marcos with representatives of the Lower Colorado River Authority. ",he introduced Mr. John Dennison and Mr. Jimmy McCloud of Electric Power Engineers, Inc., rate consultants for the City. Senator Charles Herring, General Manager of the Lower Colorado River Authority, came before the Council to state that LCRA had proposed a new retail rate for San Mar~os which was lower than the present base rate. He further stated that this new base rate should be considered an interim rate and that it would be presented to the Public Utilities Commission in January or I'ebruary, 1977. Senator Herring said LCRA could not accept the 13.1% reduction recommended by the City's rate consultants. He then introduced Griffith Morris and Frank Seifert
