I I I regular meeting, march 27, 1978 103 , page three The Mayor read the caption of an ordinance as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE II OF CHAPTER 15 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS i WHICH WAS ADOPTED BY THAT ORDINANCE OF NOVEMBER 9, 1964 AS RECORDED IN VOLUME 29, PAGE 294 OF THE MINUTES OF THE CITY COUNCIL; AND ESTABLISHING AN EFFECTIVE DATE. Mr. Hansen moved the ordinance be adopted on third and final reading to amend that ordinance creating the Library Board. Mr. Cavazos seconded the motion which passed unanimously. The Mayor read an ordinance having the folloying caption: AN ORDINANCE OF THE CITY COUNCIL OF TH,E CITY OF SAN MARCOS, TEXAS, VACATING, RELEASING AND ABANDONING A 16 FOOT EAS:E- MENT LOCATED BETWEEN LIVE OAK AND SESSOM DRIVE AND RUNNING BETWEEN LOTS 33 AND 34 AND LOTS 17 AND 18 OF THE PARK ADDITION, SAID EASEMENT BEING DEDICATED AND GRANTED TO CITY BY DEED DATED JUNE 25, 1908 AND RECORDED IN VOLUME 54, PAGE 419-421 OF THE HAYS COUNTY DEED RECORDS; AUTHORIZING THE MAYOR TO EXECUTE AND DELIVER QUITCLAIM DEEDS TO ABUTTING OWNERS IN FEE RELINQUISH- ING ALL OF THE CITY'S RIGHT, TITLE AND IN- TEREST IN SAID EASEMENT; AND ESTABLISHING AN EFFECTIVE DATE. Mr. Arredondo moved the ordinance be approved on first reading. Mr. Hansen seconded the motion. Mr. Breihan reported that a common driveway shared by the owners of Lots 33 and 34 fell in the right-of-way being abandoned. He requested the Council consider postponing decision until the adjoining property owners could reach an agreement to share common rights to the driveway. Mr. James moved the ordinance be tabled. Mr. Sutton seconded the motion which passed unanimously. Mr. Hansen moved to authorize a special meeting to canvass returns of the regular City Election to be held April 3, 1978 at 4:30 p.m. in the Council Chambers of City Hall. Mr. James seconded the motion to authorize a special meeting which passed unanimously. The City Manager presented a report on the 1977-1978 General ~ Fund Budget. It is attached and made a part of these minutes. Mr. Cavazos requested the Council consider establishment of r~gulations for carnivals held on private property.
